I would suggest jailbreaking it. it is not illegal, although there are illegal things available on it. If you decide after you jailbreak it that you dont like it, you can simply restore in iTunes, whitch will unjailbreak the device. The difference between jailbreaking an linux is that, when jailbreaking, a new actual firmware is not installed, while with linux it would be. hope this helps and atm, the 4.0 jailbreak is very unstable so i would wait on that one.

I think Ipod's OS is based off of OS X which is UNIX but is technically UNIX-like because it isn't licensed. But Linux developers have yet to run an Ipod's functions through its LINUX kernel type in Linux in youtube and you'll see as of now the kernel boots but theres no compiling of anything, no GUI, nothing. All I can tell you about is that iPhone Linux is command-line driven at this time, and lacks any on-device keyboard or touch support. Right now you can issue commands through the host system. However, I THINK a lot of the standard command lines protocols work (ls, man, rm, etc), so you may be able to run command line applications, but don't quote me on that.
I've never understood why changing the software on a device YOU own could possibly be illegal. Yeah I can understand warranty becoming void but you own the device, you should legally be allowed to do what you wish with it.
