This doesn't seem to be a matter of free speech. Shirvell is publicly showing an inability to follow a logical set of facts to a reasonable conclusion. This isn't a matter of just voicing an opinion, it's a matter of voicing an opinion which demonstrates that Shirvell's personal convictions mar his judgment.

Shirvell is clearly demonstrating that his bizarre religious notions drive his actions in such a way that it is reasonable to assume he'd show bias in court cases involving gay people.
