Try the following solution and you will be satisfied: install Firefox, go to Extras/AddOn and search for ProxTube. This will redirect only the traffic to blocked videos, runs fast enough even for HD videos and works well with the regular FF (10.1) and also with the 64 bit nightly build version...
It is extremely annoying. I made a deployment video here in Afghanistan with my fellow soldiers and posted it on my Facebook page and GEMA blocked it ! I had to give everyone on Germany my Google log in information just so they could watch it WTF ! Don't they realize there are over 60,000 Americans living in Germany who they have no right to block or censor anything?

My friend played a song from the 17th centuryon her hurdy gurdy at a renaissance fair and someone reporter her and she was charged several hundred € because the rights to that song belonged to GEMA!! It's a combination of infinite greed and absurd censorship in my eyes!

I hope that was understandable ;) And there are other things funny about the GEMA. Every blank CD sold contains a small amount of GEMA fee. So when you are illegally burning an audio CD, the artist still gets money from you.... We even have an institution called GEZ. You have to pay for some TV Stations even if you never watch them... ;)
@Willey1986 The GEMA says to me, they don't block anything, it's Youtube who does that. Actually, they have blocked my song RUNNINX and the music used in that video is all played and composed by me. GEMA is a piece of sh@t. So are many of the so called copyright holders, who screw not only the music/film fans but also the artists, who are responsible for creating these products. It's another legal robbery that is guarded by many governments. The so called Western world criticize many country leaders who apply force on their citizens. Well, at least those so called terrorist or whatever are honest to the world in the sense that they show their real faces.
Not that I am a friend of GEMA but at all it is difficult to find general rules in practice to avoid copyright infringements especially on youtube. What if someone in Germany would copy your film and publish/sell it as the own one? It is not good that your case happened but it looks like it has been solved.
Think positive, and go on creating such fantastic films :-)
Being a patent attorney here in and for Germany and Europe, dealing with intellectual property cases including license agreements I can only recommend to firstly contact GEMA, and if necessary secondly take a lawyer specialised on copyright law (you may also contact me for getting addresses).

To be fair, this is as much Sony's fault as it is GEMA's fault. When they signed a contract with GEMA they signed away all rights to licence music for public viewing in Germany. If they promised you world wide licencing rights, they duped you. They were not allowed to do that. This has nothing to do with censorship, no one forced Sony to sign those contracts.

The question really becomes, does Gema have the legal international right to remove a Youtube video. Because in this case, it certainly and very clearly does not own those rights. So the answer, soon be determined in US courts, is an unequivocal NO! (And eventually these lawsuits will number in the hundreds of millions owed to US citizens.)
I don't think you people understand (well, perhaps you do)... once music is released to the public, much like any other written material, it enters the realm of "free speech." To quote another's written word, is certainly not illegal, even when profiting (as, for example, politicians often do) from that speech. Our comments are limited here but I think it can be easily argued, legally, that those at Gema are little more than Musik Nazis.
Funny, GEMA does not want this film distributed for free, so they do a take down. Why does this make me want to watch the film then distribute it to as many people as possible. I found the creator very charming, but opposed to the mindless German bureaucracy I guess that is no chore!
Hi Nina, there is no point complaining to GEMA since you don't have a contract with them. You have a contract with Sony. It's 99% sure that Sony has a contract with GEMA. Hence, what you need to do is to ask Sony to fulfill their contract and enforce your rights in Germany. Of course Sony might have to pay something to GEMA for making your works available to the public for free. There is no point talking to anybody else than Sony. Of course they will try to talk their way out of this.

This is the same with licensed use of media. Until you have proven to GEMA that you do have the rights for the public / commercial use, it will be blocked. This is the only burden of proof i know in the german law. Maybe this problem isn't that public as it should be. It is well known in Germany (really 70% of all music-underlined videos here are blocked on youtube), but maybe many people from abroad simply don't notice it. In many cases, a video could have 80M more potential viewers!
It really is a shame that GEMA can simply expect that every media, especially songs, are under their response and that they can act like this presumption was a real fact. This is legitimized by law.
That means, GEMA blocks 70% of all public use of entertainment and dance music. They DON'T look up if the artist behind the song is even a member of GEMA. It is the artist who has to evidence the copyright of the affected song and that he wants his art to be freely available.
Yes, the GEMA sucks pretty bad. There are many ways to get around the blockade from the GEMA, but the connection gets so low, that it might take several minutes, until you can watch it.

Your video is viewable in Germany again. This proves that in this country YouTube blocks videos just on suspicion that GEMA could have any objections against those videos. This is clearly not the first time it happened. Many videos are blocked and you have to use proxys like hidemyass[dot]com

Oh, but I DO understand Copyright, and I DO think that it is useful and should be protected to a degree. @NinaPaley: Unfortunately the GEMA doesn't care what rights Sony granted you. Not even Sony can decide what can and what can not be played in Germany. GEMA is like an omnipotent machinery aiming for controlling every piece of music played in Germany - so they can charge people listening. It's like a tax on music, only that it doesn't even benefit German national finances but a very small group of musicians in Germany, some major record labels and - for the most part - people working at GEMA.
There was no "censorship", there was no blocking initiated by GEMA, this video is just a blatant attack on copyright law, which in Germany is much much much better at protecting the individual than in the US.
@tanzpartner Sorry, but this blocking definitely IS initiated by GEMA. You see, it says it right where the videos should be: The GEMA didn't grant youtube the rights to let people see the videos in Germany. Because of that, youtube had to block the video (or face some pretty major charges). So while you COULD argue that it was not the GEMA THEMSELVES that blocked the video (which is impossible to do for them anyway), they definitely INITIATED the blocking. TBC in part 2...
It's pretty much like holding a gun to somebody's head and telling them to...idk...spray paint a wall or something. Sure, THEY didn't spray paint the wall themselves, but they sure as hell didn't leave the person doing it much of a choice.
What the GEMA does is, while unfortunately legal, amoralic and counter productive. The basic idea was and is pretty nice, but due to their antiquated methods, relentless bureaucracy and unrational decisions they fail on every level.

As an American living and working in Germany since 1996 and using the internet since then, I'm truly dismayed recently when I try to look at videos on the web and get different messages that the video cannot be seen in my country. Ugggghhh! What good is a global internet when I can't get the information and especially in a country which prides itself in freedom of information!! It's not just your case which bothers me.

Folks in Germany, can you view the one at the link I put in the description? There's another commercial-laden one, not posted by me, that is viewable in Germany, maybe because the tons of commercials it contains (that don't benefit me, since I didn't post it) satisfy GEMA's income requirements. It's the one WITHOUT the commercials, the nonprofit one tied to the Sita Free Distribution Project, that is blocked.
Why do these pathetic people claim copyright on songs made by artists who are dead long ago. Many videos are blocked especially in Germany. I find it disgusting that these people still make money from the dead artist people instead of allowing to reuse them. And do they music companies pay it to artists' families?

I don't know whether you have noted that GEMA has made a press release about the case, which can be found on GEMAs web site (and I can't post the URL). Also, it is in German.
Basically GEMA says that they did not block the video, but that it must have been some other copyright holders or Youtube itself, and that what the flash is saying is misleading. Should I try to provide a full translation?

in recent past GEMA and YT had a dispute concerning a license agreement. YT took down many videos and claiming they had no choice. that reduced GEMA's standing and music companies (members of GEMA) critized GEMA for something they had nothing to do with.

And yes, GEMA sucks. Some months ago, they actually asked all day cares and kindergardens in Germany to register every single hardcopy of traditional childrens' songs that they were distributing among the children.
Luckily, this had the effect that the "Musikpiraten" created a song book with 50 of these songs that they put into the public domain, and furthermore they send out one copy of this book to all day cares in Germany.
@olaflenz it's bullshit. It was one publisher that signed up with GEMA to use their service. That publisher demanded to be paid for the copies. GEMA did their contractually required part and had to take the blame. Get your facts straight.

Not that I am a friend of GEMA but at all it is difficult to find general rules in practice to avoid copyright infringements especially on youtube. What if someone in Germany would copy your film and publish/sell it as the own one? It is not good that your case happened but it looks like it has been solved.

Being a patent attorney here in and for Germany and Europe, dealing with intellectual property cases including license agreements I can only recommend to firstly contact GEMA, and if necessary secondly take a lawyer specialised on copyright law (you may also contact me for getting addresses).

To be fair, this is as much Sony's fault as it is GEMA's fault. When they signed a contract with GEMA they signed away all rights to licence music for public viewing in Germany. If they promised you world wide licencing rights, they duped you. They were not allowed to do that. This has nothing to do with censorship, no one forced Sony to sign those contracts.

The question really becomes, does Gema have the legal international right to remove a Youtube video. Because in this case, it certainly and very clearly does not own those rights. So the answer, soon be determined in US courts, is an unequivocal NO! (And eventually these lawsuits will number in the hundreds of millions owed to US citizens.)

I don't think you people understand (well, perhaps you do)... once music is released to the public, much like any other written material, it enters the realm of "free speech." To quote another's written word, is certainly not illegal, even when profiting (as, for example, politicians often do) from that speech. Our comments are limited here but I think it can be easily argued, legally, that those at Gema are little more than Musik Nazis.

Funny, GEMA does not want this film distributed for free, so they do a take down. Why does this make me want to watch the film then distribute it to as many people as possible. I found the creator very charming, but opposed to the mindless German bureaucracy I guess that is no chore!

Hi Nina, there is no point complaining to GEMA since you don't have a contract with them. You have a contract with Sony. It's 99% sure that Sony has a contract with GEMA. Hence, what you need to do is to ask Sony to fulfill their contract and enforce your rights in Germany. Of course Sony might have to pay something to GEMA for making your works available to the public for free. There is no point talking to anybody else than Sony. Of course they will try to talk their way out of this.

This is the same with licensed use of media. Until you have proven to GEMA that you do have the rights for the public / commercial use, it will be blocked. This is the only burden of proof i know in the german law. Maybe this problem isn't that public as it should be. It is well known in Germany (really 70% of all music-underlined videos here are blocked on youtube), but maybe many people from abroad simply don't notice it. In many cases, a video could have 80M more potential viewers!

It really is a shame that GEMA can simply expect that every media, especially songs, are under their response and that they can act like this presumption was a real fact. This is legitimized by law.
That means, GEMA blocks 70% of all public use of entertainment and dance music. They DON'T look up if the artist behind the song is even a member of GEMA. It is the artist who has to evidence the copyright of the affected song and that he wants his art to be freely available.

Oh, but I DO understand Copyright, and I DO think that it is useful and should be protected to a degree. However, I think that GEMA is doing it totally wrong and that the music industry in general uses Copyright as a means to make money, money that should actually go to the artists and not to the huge organizations those people are running.
Also, Copyright is counter productive when it gets in the way of non-commercial art and people trying to enjoy it. If somebody makes a profit...-TBC...

GEMA is like an omnipotent machinery aiming for controlling every piece of music played in Germany - so they can charge people listening. It's like a tax on music, only that it doesn't even benefit German national finances but a very small group of musicians in Germany, some major record labels and - for the most part - people working at GEMA.

@tanzpartner Sorry, but this blocking definitely IS initiated by GEMA. You see, it says it right where the videos should be: The GEMA didn't grant youtube the rights to let people see the videos in Germany. Because of that, youtube had to block the video (or face some pretty major charges). So while you COULD argue that it was not the GEMA THEMSELVES that blocked the video (which is impossible to do for them anyway), they definitely INITIATED the blocking. TBC in part 2...

What the GEMA does is, while unfortunately legal, amoralic and counter productive. The basic idea was and is pretty nice, but due to their antiquated methods, relentless bureaucracy and unrational decisions they fail on every level.

Everything going beyond that does nothing but repress artistic freedoms and the imo natural human right for cultural expression and participation.
That is why we definitely need a new and improved Copyright, and new means to protect it. The GEMA is outdated.

Ugggghhh! What good is a global internet when I can't get the information and especially in a country which prides itself in freedom of information!! It's not just your case which bothers me.

There's another commercial-laden one, not posted by me, that is viewable in Germany, maybe because the tons of commercials it contains (that don't benefit me, since I didn't post it) satisfy GEMA's income requirements. It's the one WITHOUT the commercials, the nonprofit one tied to the Sita Free Distribution Project, that is blocked.

I don't know whether you have noted that GEMA has made a press release about the case, which can be found on GEMAs web site (and I can't post the URL). Also, it is in German.
Basically GEMA says that they did not block the video, but that it must have been some other copyright holders or Youtube itself, and that what the flash is saying is misleading. Should I try to provide a full translation?

in recent past GEMA and YT had a dispute concerning a license agreement. YT took down many videos and claiming they had no choice. that reduced GEMA's standing and music companies (members of GEMA) critized GEMA for something they had nothing to do with.

The GEMA claims to protect intellectual property but recently even record companies are fed up with the inability of the GEMA to reach a rational agreement with Google and Youtube after years of negotiations. In den USA können die rechte für Songs für 50 $ verkauft werden und wenn die Komosition dann ein Hit wird, siehst du als Komponist keinen Cent mehr. In Deutschland ist so ein Geschäft sittenwidrig und man kann als Urheber dagegen vorgehen. Ich sehe das eher so: ASCAPS sucks

Die Institution der GEMA ist sicherlich reformbedürftig, das stimmt, aber im Gegensatz zu den anderen Verwertungsgesellschaften kommen immer noch Tantiemen auch bei kleinen Künstlern an, was man von der amerikanischen Verwertungsgesellschaft nicht sagen kann, dort bleibt das Geld bei den Grossen hängen,

Yep, the film is available now.
And yes, GEMA sucks. Some months ago, they actually asked all day cares and kindergardens in Germany to register every single hardcopy of traditional childrens' songs that they were distributing among the children.
Luckily, this had the effect that the "Musikpiraten" created a song book with 50 of these songs that they put into the public domain, and furthermore they send out one copy of this book to all day cares in Germany.

@olaflenz it's bullshit. It was one publisher that signed up with GEMA to use their service. That publisher demanded to be paid for the copies. GEMA did their contractually required part and had to take the blame. Get your facts straight.

@tanzpartner You are right, it looks as though this really wasn't the GEMA, but the VG Musikedition. Mea culpa. I just repeated what the media wrote during the last months. I'm not a journalist, though. Still, I'm sad that journalists made this error.
