Are you talking about the British band Samson?, as far as I know the name was derived from the vocalist's last name, Paul Samson while this Indonesian band was inspired by biblical Samson, and Samson is a common name. I think that is why they're not considered violating the rules.

But it is also a possibility that the disbanded of the original Samson is the factor which make it all legal, like you said.

@wedged11 I asked my mate, he said it could be that the band is disbanded but it could also be that this band is Indonesian or whatever. you register your band to whatever collection society governs your country or area.. so because they're in diffrent areas they might have gotten away with it. also they could have gotten permission to use the name.
