I think the mother deserves a punishment, but the death of one child should be enough to teach her a lesson. If she crosses a road with her two kids and gets one of them killed, she is a terrible, irresponsible mother - end of discussion. Even if the guy was driving way too fast, was drunk, stoned and blind, you still have to make sure it is safe to cross the road, especially in the dark when oncoming traffic has very little time to react.
This actually makes sense, because it is not been established that the man's intoxication was directly causal to the accident - the accident would have happened whether he was drunk or not. So he can be charged with DUI and leaving the scene, but there is no compelling reason to charge him with murder. However, I feel the mother's charges are a little over-the-top.
At the end of the day, maybe if she didnt jaywalk she and her kid mightve not been in danger. However Drunk drivers need to get the sentance which they deserve, and its stupid giving a sentace of 6 months in jail after the perp have had prior hit and run convictions and after he killed a child. This is result of poor city planning, there should be a crow walk at every bus stop. It was dark. As a person who has nearly hit jaywalkers before at night, sometimes they are very hard to see. However, a van with his brights on is not hard to see. She should have gotten out of the way. He should get more jail time than the six months, but because of the drinking, the repeat offense, and the hit and run. @PartiallyRibena i'm from the uk too, and i thought this too, and then an american pointed out to me that it's essentially a different system of right of way. in the uk, as a driver, you expect people to be 'jaywalking' and you are more cautious of pedestrians, whereas in the usa, where it's illegal and not common practice you would not be looking out for it. not a great example, but it's more akin to someone pulling out of a side street infront of you when you're driving on the main road.

Another thing the news didn't mention was that there was roughly a dozen other people from the bus crossing at the same time as that family. And the community had requested a crosswalk at that location every year for the passed 7 years.

Crosswalks are meaningless, an auto of any kind MUST yield or stop for a crossing pedestrian on any street whether it's legal to cross or not. The fact he flashes his brights but did not stop or swerve is proof he had the ability to avoid the child. It was dark. As a person who has nearly hit jaywalkers before at night, sometimes they are very hard to see. However, a van with his brights on is not hard to see. She should have gotten out of the way. He should get more jail time than the six months, but because of the drinking, the repeat offense, and the hit and run. But don't act like the Mom isn't guilty at all. 3 years? Maybe too much, and not sure if she needs anything, she probably learned her lesson.

@PartiallyRibena i'm from the uk too, and i thought this too, and then an american pointed out to me that it's essentially a different system of right of way. in the uk, as a driver, you expect people to be 'jaywalking' and you are more cautious of pedestrians, whereas in the usa, where it's illegal and not common practice you would not be looking out for it. not a great example, but it's more akin to someone pulling out of a side street infront of you when you're driving on the main road.

Why would that be an accident then? She didn't intentionally hit the deer, just like she didn't intentionally get hit by a car. Suppose she's a centimeter over the dividing line when she hits the deer, or is going 1 mph over the speed limit? Even if she where carrying 1 child in the arms, it is still child endangerment to cross like she did and she would still deserve a punishment.
One inch more or 1mph over the speed would not require punishment if there is a good reason for it, ambulances can break speed limits, if you jaywalk to save a child from the middle of the street that would be OK. If you are going 1 mph over or 1 inch away, then yes, you deserve to be corrected or get a punishment as that may cause an accident.

Another thing the news didn't mention was that there was roughly a dozen other people from the bus crossing at the same time as that family. And the community had requested a crosswalk at that location every year for the passed 7 years.

I agree that the woman should have been prosecuted but she shouldn't get a sentence that harsh. She suffered enough for her lose.

If her son died because of her jaywalking then I'd say she has learned her lesson. And learned it very well. 3 years in jail on top of that is just excessive and cruel. Especially since the driver who was drunk, on medication and partially blind got a much lighter sentence. The justice system is f*cked up man.

Jaywalking is such a laughable crime. I'm from the UK only only today found out what jaywalking is and that it is illegal in the US. Of course it's sad that someone died, but its not as if death because of jaywalking is high in the UK because it is legal.

@coolbanana165 Never been to the UK, but I have been to Italy. It seemed drivers there are much more considerate of pedestrians there than here. Americans are way to ignorant of their surroundings. Would that surprise you?

@coolbanana165 Yeah, but it's not something that police actually enforce. It's just used as a loophole for police to use to stop someone they suspect of being in a gang or something. It's like littering. If you actually arrest or fine someone for jaywalking or littering, all the other cops call you gay.

There's barely any sidewalks in most places in Georgia, let alone crosswalks - so how the hell are you supposed to get anywhere on foot unless you jaywalk? The guy driving should have got some serious time and the money spent on this ridiculous prosecution (that has now been dropped) would have been better spent on making pedestrians safer in the state.

This is what happens when you get an ambitious prosecutor who is aspiring for higher office and who will zealously pursue charges in any case that will boost his or her conviction rate. The prosecutor obviously does not have a conscience and I am sure that they pursued this case because it's an easy conviction: she admitted to jaywalking; she and her children were hit; one died; she is poor, she's urban; she's black. To top that off, the county prosecutor is an soulless, heartless asshole.

Crosswalks are meaningless, an auto of any kind MUST yield or stop for a crossing pedestrian on any street whether it's legal to cross or not. The fact he flashes his brights but did not stop or swerve is proof he had the ability to avoid the child. I'm no fan of coddling mothers who get their kid hurt or killed for stupid or purposeful actions, but the loss of her child is enough punishment.
