Many people get first degree murder for killing someone with no evidence of more than momentary premeditation, actually for felony first degree murder, no intent to harm is necessary. Because he wasn't handcuffed yet, Mr. Grant wasn't searched. So Mehserle had a reasonable suspicion to believe he was armed. But he didn't want to shoot him dead, especially not in front of dozens of people.

Excessive force was used when he went for his tazer after Grant stopped struggling. Any decent cop is well aware of their weapons. Cops spend hours at the shooting range with their guns. Tazer is the wrong size, feel, weight etc. I don't think he meant to kill him, but he did mess up, and it costs a life. He was simply a bad cop.

It's not just that, 1luv. Even if the whole Taser confusion argument is BS--and it very well could be--Mehserle clearly didn't mean to fire the gun when he did. Moreover, he fired just one shot, in a part of the body that normally will not result in the victim's death. He was indeed guilty of negligently handling his weapon, and his negligence resulted in an unlawful death. That's manslaughter. It was the right verdict. In most cases, Grant would have lived. And even if he had been shot in the head, it wouldn't have proven murder, due to the way it went down. It's not as if Mehserle shot him through the heart; also, the initial gunshot wound isn't what killed Grant. It was the deflection of the bullet into his lung that killed him. Not even an expert marksman can plan something like that. Even if the Taser story wasn't true, the trajectory of the bullet basically disproves murder.
