I haven't read any of her opinions yet.

However I did try to find her stance on the Ricci case by going through the paperwork.

Her own words are missing from the opinion though. She basically just concurred with the opinion.

I'm not a lawyer so it's hard for me to understand legalese, but I do know one thing.

Her "A Latina Judge's Voice" lecture was written very intelligently. I just don't like her opinion on matters of race and sex.

BTW, I have since read the various Ricci opinions, and I think she got it wrong. It's not clear that her error was the result of any bias. I understand where the court was coming from. The City scrapped the test to avoid a lawsuit by the minority groups. But, I still think the legal reasoning was wrong.

gimme a break. Why you buy into the right-wing spin of her comments? they are clear and understandable within the context of racial discrimination, it's even more nuanced than what Alito said at the time...

I am not buying in to any right-wing spin, but thanks for the insult. What she said was not nuanced. \She suggested that sex and ethnicity would cause a judge to reach a different result. That may be true, but it shouldn't be. She then suggested that, in discrimination cases, minorities and women are more likely to get it right than white men. Biases are just as likely to cause a minority to see discrimination where it does not exist as to cause a white male to fail to see it where it does.

Also, your point is moot since she obviously follows the rule of law quite well, if you take a look at her record.

Alito did not say the same thing. He said he considers his background and it influences his decisions. She said her background ought to, more often than not, make her decisions better than those of a white male. That was a qualitatively different statement. She is suggesting that her personal background makes her a better judge than white men.

As for her record, are you suggesting that you have read all of per cases? The only one I read was Ricci, and she got that one wrong.

Well, the corollary of Alito's statement is that his background would help him make better decisions regarding race discrimination cases, which is what Sotomayor said.

Regardind the Ricci case, you fail to mention that Ricci was a white male, and Sotomayor sided with him... are you saying now that because of that case, Sotomayor is a white supremacist?

and for the record if you are accusing someone of something the burden of proof is in your hands.. so it is you who need to read all her cases.

I InRicci, the fire department threw out a test that was being used to determine promotions because not enough minorities passed the test. The plaintiffs were white males and one hispanic male who had passed the test. Sotomayor ruled against them, upholding the department's decision to scrap the test.

Alito did not say he would make better decisions than women or minorities.

Why do I need to read her cases? I took offense at her comment. I can't be offended without reading her cases?

Lol, you are making things up. 18 White males, 1 Hispanic passed a promotion test. New Haven threw it out because it was racially skewed. Sotomayor upheld their decision.

Sotomayor's one paragraph decision did nnnottt side with Ricci. it took a supreme court reversal on june 29th to find in Ricci's favor.

Judge Sotomayor's statement is not racist, she is just wrong. Second, I would hope that a wise white man with the richness of his experiences would more often than not reach a better conclusion than a Latina woman who hasn't lived that life.

Thank God. The choice could have been worse.

I hope Obama starts improving our courts and knocks down the veil of secrecy that prevails to hide the injudicious acts of our judges that are being perpetrated against so many innocent people. The injustice of our judges could be as little as a subtle overlooking of a controlling law to advance a subjective position of the judge. This is injustice, and this needs to stop.

She is the epitome of an activist judge. She has proven that time and again in HER OWN words. Most of her decisions in the Court of Appeals were REVERSED by the Supreme Court. What that that tell you? Does THAT sound like she observes the letter of the law OR her own agenda?

Where do you get your facts? The Supreme Court reviewed less than 1% of her opinions, and reversed 6 or 7 of those. Reversed 7 times in almost 15 years - wow, what a horrible record!

Do you happen to know any of her opinions? What about them evidences "judicial activism"?

Judge Sotomayor is not qaulified to be a supreme court justice.
