Grant was NOT resisting arrest. If trying to communicate with an officer is resisting arrest, then I suppose everyone who has ever been arrested is guilty. This was also not an accident. I don't own a fire arm presently but I have fired some in the past and I can tell you for certain that the difference between a taser gun and a firearm is significantly different in weight and make. Even if you are distracted, as a trained professional, you would notice the difference. We just have different opinions and it does nothing to go back and forth about it.

@Mr755134 A presumption of innocence applies in court, not with police. They were being questioned in an assault, and during so Grant assaulted two cops. There is no presumption of innocence there. Grant was ordered to stay seated, he kept getting up. They tried to cuff him, he resisted. There is no presumption of innocence when you are being arrested, otherwise they could never arrest you! You comply with the arrest, and you fight in court. That is where you are innocent until proven otherwise.

My honest opinion on the upcoming trial. I think Mr. Mehserle will get 25-30 in prison with parole after 10. Unless he confessed that he intended to shoot and kill Mr Grant than he'll get life. The prosecution has to prove that he had all intentions to kill and by the video alone it was an accidental shooting. The DA will probably have his hands full with this case. Very tough case to defend. I feel sorry for all families involved in this case. R.I.P. Oscar Grant!!!

Grant was NOT resisting arrest. If trying to communicate with an officer is resisting arrest, then I suppose everyone who has ever been arrested is guilty. This was also not an accident. Grant rolled on to his back initially when the cops forced him to the ground, to fight them off. Grant refused for 30 seconds to give his hands. That IS resisting arrest. And this absolutely WAS an accident. As was effectively proven in court, Mehserle intended to pull his taser and pulled the wrong weapon.

Firearms experts & use of force experts have testified his actions were 100% consistant with firing a taser, and inconsistant with firing a gun. Not to mention the man yelled "Fuck this I'm tasing him" to which Grant replied "Don't tase me!" (as he was tased before for resisting arrest a year prior). No one with training would intentionally fire downward against a hard surface that close. That's suicidal.

I don't own a fire arm presently but I have fired some in the past and I can tell you for certain that the difference between a taser gun and a firearm is significantly different in weight and make. Even if you are distracted, as a trained professional, you would notice the difference. We just have different opinions and it does nothing to go back and forth about it.

@Mr755134 A presumption of innocence applies in court, not with police. They were being questioned in an assault, and during so Grant assaulted two cops. There is no presumption of innocence there. Grant was ordered to stay seated, he kept getting up. They tried to cuff him, he resisted. There is no presumption of innocence when you are being arrested, otherwise they could never arrest you! You comply with the arrest, and you fight in court. That is where you are innocent until proven otherwise.

If the firearm the cop used has a safety mechanism to disengage in order to fire his weapon, then the prosecution could fry him.

There's no doubt in my mind that this cop is being scapegoated. If you think any cop in that situation would think he could get away with murder, you're fabricating racism. That cop was improperly trained on the use of his "Tazer". Watch the video closer. He backs up and shoots him squarely in the back. Right where "Tazer" training teaches. One life gone, one life heading for distruction, all for the safety of Politians & their contributers. Someone help that cop soon!

If I'm a contrator and i leave my circular saw exposed and someone cuts their arm of. I could be persecuted. If I'm a Bus driver and i fall asleep at the wheel, and someone dies on my bus, i will be prosecuted. If I'm a gun owner and my neighbor kids spends the night at my house and accidently shoots himself with my gun, I will be prosecuted. This cop is a professional, he's not a security guard at a bus depot. He's an officer of the law. period. Undertrained? You're just making excusses.

Oscar "da Myer weiner" Grant was convicted of 8 drug charges, 2 of them trafficking within the last year, recently released from prison in September, was deliquent on his child support, was arrested for resisting arrest and got taser as a result in 07, whatever else he did before he was 18 is sealed. this thug deserved what he had coming.

My honest opinion on the upcoming trial. I think Mr. Mehserle will get 25-30 in prison with parole after 10. Unless he confessed that he intended to shoot and kill Mr Grant than he'll get life. The prosecution has to prove that he had all intentions to kill and by the video alone it was an accidental shooting. The DA will probably have his hands full with this case. Very tough case to defend. I feel sorry for all families involved in this case. R.I.P. Oscar Grant!!!

The Cop was highly unqualified to be a police officer and he was poorly trained and skilled, which led to the accidental manslaughter.
Murder is premeditated. This is not murder. It is a totally unqualified police officer who shouldn't have been in the position he held nor and situation. The Cop wasn't clearly and mentally qualified to be in that situation. In other words the Cop was totally incompetent.

@cristinabaker you probably never 1) handled a gun in a situation of pressure and 2) never took an IQ test. Had you done both, you'd know. There were people all around the cops yelling at them, and the people being arrested were hostile. You suddenly think you see someone making a move for the gun, you react. You don't look at your own gun, and think about letting the safety off. These are trained, conditioned responses you do automatically.

They were making what, as far as the available facts show, was a lawful arrest, when the one cop either accidentally (which appears to be the case) or intentionally shot the guy. There were no accomplices. Nor is there any indication that anyone has impeded the investigation in any way.
