The general rule is that racial comments, while offensive, are not likely to spur violence. Now, if the NY Post wrote "All black people should be hung," that is another story. But, really, even that is not, legally speaking, likely to spur violence. If, however, a pastor told his church that to protect the word of God everyone should go downtown and beat the gays out of town--now, that would not be protected speech.

The executive branch signs. Congress writes. If the cartoon was directed at Obama it would have said "sign," not "write." Therefore, if the chimp logically represents anyone it is Pelosi. But, most likely and most logically, the chimp is just a metaphor for the bill and isn't supposed to be anyone.

The general rule is that racial comments, while offensive, are not likely to spur violence. Now, if the NY Post wrote "All black people should be hung," that is another story. But, really, even that is not, legally speaking, likely to spur violence. If, however, a pastor told his church that to protect the word of God everyone should go downtown and beat the gays out of town--now, that would not be protected speech.
"If it could cause mass racial violence" is not the legal standard.

I think the controversy could have been avoided if an explanation had been given quickly. I've heard of the idea of putting chimps in a room with typewriters and they could write "Hamlet" but most people don't know that. At first I was extremely offended until I remembered I saw a cartoon with chimps typing. I think Sharpton is making the situation worse. Let's move on to unemployment. The real issue.
