@narutorock998 depends on how you look at it - he was part of the massive group of Avengers that was briefly assembled during the search for Morgan Le Fay when Avengers all over the world were attacked shortly after the heroes thought lost fighting Onslaught returned from the "Heroes Reborn" universe. However, Captain America, understanding that Spidey had his hands full already, let him off the roster before the mission was sent out.
@narutorock998 Years later, he was a core member of the reformed Avengers seen in "New Avengers", and continues to be involved with them throughout the Civil War, before joining up with Captain America's "Secret Avengers". Tony Stark even gave him a new outfit for a brief while.
@CelticSouthland - He's based on the Ultimate version of Nick Fury, an African-American version, who himself was based on the likeness of Samuel L Jackson, so it kinda came full circle when they premiered him at the end of "Iron Man"
