  • People like Olbermann and Moore are the reasons I could never consider myself a liberal. Most of the ideas liberalism offers I seem to relate to, but if the belief relates me to these assholes, fuck it. Being independent or free thinking is more interesting anyway.

  • @jcarbis No, I already knew of libertarianism, and for a short time, considered me self as so. But I've come to see most libertarians always claim that they believe in individuality, but the second you seem to not completely agree with the tenets of libertarianism, you aren't considered one of them, and seen as a fake. I know that sounds petty, and there are lots of libertarians who are open minded, but I just don't want to attract myself to any beliefs anymore, I'm kind of done with 'isms'.

  • @jcarbis Whenever I see conservatives being way too conservative, and calling themselves libertarians, it is really annoying. Self Soverign seems like a nice term, but I just refer to myself as simply, myself, or I just use my name. I feel like there's no to put myself into social and political groups, becuase I usually agree with only a certain amount of what they say and I do hate the bias and dogma (especially in a political party) that comes with any ideology.

  • @MotherNikita: Libertarians took their philosophy from conservatism, not the other way around. Conservatism has it's origins going back to Cicero and Aristotle all the way to what's called "The Scottish Enlightment" of the eighteenth century. People like Adam Smith and Edmund Burke. Libertarianism has been around since when? the 1990's? No offence, but you know absolutely nothing about political philosophy in historical terms.

I also want to say, I do agree with the legalization of drugs and other personal liberties, and I love standpoint of "if you want to kill yourself, go ahead. " It seems cruel, but no one's forcing anyone into drugs. Having fewer people, who did it to themselves, will probably lead into a better or at least more convenient society.

    Gay people have the exact same rights as everyone else--To marry with the opposite sex.

    They want the EXTRA right, based on their sexual orientation, to marry with the same sex. And this has severe Equal Protection implications. (i.e. opens the door to people who want to marry animals, minors, their car, et. al.)

    What gay people are asking for is the extra right to marry the same sex. This is currently not a right.

    This is Con Law 101, but it's apparently a very confusing concept for non-lawyers to understand. Seriously, put your emotions aside and try thinking harder, at least to understand the legal dilemma.

    What you are talking about falls under a different constitutional test called rational basis.

    To your question, your argument works against you on the theory of stare decisis: If it has already been decided that gender can be determinative of the law in one area, thus... And there you face part of the conservative argument.

  • It's "against the law" for a different reason, i.e., one is considered a constitutional right and one is not.

    They have different legal standards and different reasons for coming under regulation.

  • This is how it works:

    States put bans on gay marriage. Someone can challenge the constitutionality of the ban if they're injured. But...

    (1) There is nothing in Supreme Court case law and nothing in the constitution that supports gay marriage.

    (2) Challenges to these bans must meet a very high "standard of proof" that they're unconstitutional.

    (3) If one alternative form of marriage is allowed, then all alternative forms of marriage must be allowed under Equal Protection.

  • I don't agree with #3. People say that, but its illegal to have sex with a minor and bestiality is pretty much banned in most states. You have to say "I do" and sign documents...its not like animals can do that. Just because it doesn't say you can in the constitution doesn't mean you should be barred from it. Life, Liberty, and the pursuit of happiness. Their not hurting anyone and they are pursuing happiness, I don't see the problem.

    What you or I think should be OK can be challenged by that hallowed document. There are a lot of obstacles.

  • XG, since when did the Supreme Court give a shit about the Constitution? Where was the "standard of proof" in Roe v. Wade or Brown v. Board? In those cases they didn't even use precedent (the whole basis of Anglo law), they just pulled any kind of bullshit data they wanted from amicus curiae briefs filed by those with political agendas to make their decisions. It's ridiculous that they can even get involved in these matters to begin with, the debates should be resolved by the individual states.

  • They did use the Constitution in Roe although many would say it was misapplied. Roe is definitely a stretch.

    The precedent is that privacy was established by Griswold v. CT and that this privacy extended to physician-patient confidentiality with respect to abortions.

    Privacy is not in the Const. but many "liberals" think it's implied.

    I agree that states should decide, but all states must adhere to the federal Const. in the end.

  • Griswold v. CT ruled that the feds wouldn't interfere in the bedroom. Roe v. Wade goes far beyond that principle, abortion had (correctly, imo) been considered murder by every state up until that time, plain and simple. Nobody would dare think that the precedent set by Griswold would allow for rape behind closed doors, right? So why should it apply to the barbaric practice of abortion? I don't disagree with the right to privacy, btw, it is more than "implied", if you will, in the 4th amendment.
