They may not choke but a lot of children might. Also it could be construed as the companies fault for making the product in the first place. It is called product liability.

This isn't teaching anything, they are innanimate objects.
If your 3 year old earns his own money and is capable of going down to the store and buy a box, then maybe yeah, you got a problem.
But if he's just a regular kid you're the only way he can get those.
If you don't like the idea, don't buy them for your kid.
