I have a better idea...don't drink and drive. There are these special vehicles called "cabs" with drivers called "cab drivers" who will drive you home for a few bucks.
So the on-scene testers are not used in NJ. Not sure where they are allowed. There is a lot that goes into a DUI arrest to follow through to conviction. An officer has to invest a lot of time and effort into geting it done properly so most are not going to go through the process to purposely screw someone if that person isn't truly impaired. If you are involved in a fatal/serious injury crash and you have alcohol in your system even not being impaired can be a problem bothin all Courts.
This is why I only stick with one beer if i'm a driver, I know that after an hour the beer is out of your system, but I go a step further and have food wile I play pool!

If people are going to drink and drive and risk other's safety, maybe they should spend a few hours in jail. The purpose of police making a presence is to deter crime, so if people know how to bypass that, whats their motivation for NOT driving drunk aside from the few that actually care about the welfare of others. Its one thing to know your rights so you can protect yourself. Its another thing to take advantage of a disciplinary system and get away with what you please.

First of all, he's not telling people how to commit a crime or how to avoid being investigated. If you're pulled over or stopped by a law enforcement officer, you're already being investigated - regardless of why you were stopped. The attorney was educating viewers on the constitutional rights that they have, just specifically in the situation of being suspected of DUI. Nobody should ever drink and drive, but by the same token, nobody should ever be unaware of their own basic, civil rights.
Just the first DUI costs about $5000 in attorney fees, court costs, fines and higher insurance rates plus sometimes community service or jail time. And of course you have the discomfort of being handcuffed for around an hour or longer. If you kill someone while driving drunk, you can go to prison for manslaughter even if the accident was not your fault. A cab ride is MUCH cheaper. If you are going to drink, drink responsibly.
you are absolutely correct. he is telling you how to get out of a jam if you are drinking and driving. however, like i said previously, there is a huge difference between drinking and driving and being drunk and driving. haven't you ever had a single beer with dinner? it stays on your breath regardless of the fact that you are far from being "intoxicated." this video is merely telling you to not drive through areas where cops will smell the ONE beer you had and assume you are drunk.

Alcohol consumption does diminish your cognitive skills and most police are not going to arrest you if you are not absolutely impaired. The alcohol test machines are computerized and are almost completely free of being tampered with if done properly. If done improperly they are programmed to flag errors. You are either missing my point or are just posting anti-responses for shock value.

And I'm not sure what you mean about the alcohol test machines being computerized and free from errors as there is more than one kind of test. The breath test that they give on the scene is highly innacurate and isn't admissible in court. The breath test at the station is more accurate, but by that point you've already been arrested.
Well almost all people stopped and questioned say they only had "1 or 2 drinks". The Breathalyzer has been phased out everwhere I believe and that was the only machine I have seen that is done manually. The newer ones Intoxilyzer, Alcotest and such are all computer driven. You only enter their information and the computer does the rest. The on-scene breath machines are inaccurate because in order to obtain a true reading you have to wait a minimum of 20 minutes for mouth alcohol to go away.
@EIB11C Most people use the term breathalyzer to describe a breath test. I wasn't specifically naming a brand. Anyway, all of the breath tests only measure alcohol on the breath, not alcohol in the blood. The machine is based on the premise that the ratio of alcohol in the breath to alcohol in the blood is 1:2100 but in reality the ratio varies from between 1:1300 to 1:3000. So, someone could blow .08 and the actual level of alcohol in their blood could be higher or lower than that.
