  • I guess it was a good outcome. But, it kind of seems like allot of wasted time esp. when you consider that the person was arrested. In my opinion the cops should never get away with something by claiming ignorance of the law or because they did not intend to break the law etc. It's too damn easy to act like an absolute moron and get away with basically anything you've done.   • I would make one suggestion: In the video @ReasonTV says you should ask which law you are breaking if challenged. The police don't have to tell you this. You only have to be informed of what charge you're being accused of if you are issued a warrant or citation. So if you're going to ask about what law you are breaking, tread carefully. I would suggest consulting an attorney beforehand.

  • I worked in law enforcement for about five years until I couldn't stand it any longer. The public needs to know that cops are not 'heroes' or any of that other BS. Most are thugs of below average intelligence who couldn't care less about the Constitution or the citizens they are supposed to serve.

    oh, i know they dont give a shit about the constitution. i've had cops tell me that if i take advantage of my 5th amendment right to remain silent, that they would arrest me for obstruction. i still refused, and once they found out that they couldnt legally charge me w/ that crime, they charged me w/ felonly possession of stolen goods where the "goods" were gaming supplies in my car.

    never arraigned, charges dropped, still spent 3 days in jail for no reason.

  • @TheoryIsSpeculation It was my understanding that was a ruling from the 1st Circuit Court, which only holds jurisdiction over certain States; however, it is a good start and precedent for the rest.

  • @1775novten Certain states and areas of states pass 'laws" which fall under the catagory of malum prohibitum. This is something that is declared an unlawful act by virtue of a statute. Technically these are not laws; as they are not bonded by the people. Rather than get involved I would like to promote the local courts challenging the higher courts for clarification....and watch the feathers fly. Instead; we citizens get caught in the middle. Higher court says legal, lower court says pay a fine.

  • @ohannahdad Yes, I agree case law is not technically "law", but at times it's almost better because it sets a precedent of what is Constitutionally acceptable. Bottom line is that I'm glad that courts are recognizing that filming the police, and anyone is public for that matter, is not wiretapping and should be allowed and expected.

One side records, both are allowed obviously/ Every telephone call is recorded, or you are told in a message that it is, feel free. All gov departments are "in public". Their telephones rigged to record. Cop cars rigged to record. If their cruiser is pointing at you, point it out to the cop "we are being recorded, even better with more angles".

  • Sigh, so many posters obviously don't know that a federal circuit court recently ruled that we have the right to record ALL public servants during the conduct of their duties. That INCLUDES JUDGES and court proceedings. No statute can violate a right, and any law that's been ruled unconstitutional, is NULL AND VOID AB INITIO (from the beginning.) That also means retroactively. So if you've ever had trouble, you can revisit the issue based on the above.

  • There may soon come a day where citizen reporters carry paramilitary equipment similar to that of law enforcement when exercising their constitutional right to walk down a street without being subject to molestation by armed operatives of the government. The constitution allows that similar action to protect one's freedoms be taken against those who illegally act with force to deny them.   • I was taking photos the other day and I wasn't really sure where I was, but it turned out I was on the property of a maximum security prison and, when an officer saw my friend and I, he told us that merely standing there was a felony, confiscated our cameras, and then he, the warren, the sergeant, and others proceeded to interrogate us for 2 hours. Assuming that we were up to no good, they couldn't believe we liked to take pictures for the sheer fun of it.

This is suppose to be why we have a constitution that sets defined limits on what government cannot take away from us. Cities themselves could privatize police forces and set defined limits on that as well, allowing multiple companies to compete for the contract. (part 1)

My room mate is a police officer in Chesapeake, VA and a "city representative" came to his precinct and told them to write more tickets because city personnel were in danger of not having funding for their jobs. They had to be "told to" because this particular city doesn't have "quotas" for tickets like some cities do. Nevermind the "dismissed" charges in which you still get to pay $70 for being not guilty...

But the corruption comes from taking money through either taxes or printing more fiat money and purchasing things the general consumer would otherwise probably not buy. This relationship is mutualistic, the very same corporations that receive this "stolen money" through sweet heart deals, subsidies, grants etc also contribute to the campaign of who ever champions the things that benefit them

IMHO those involved with such things should be put on trial. Congress was never intended to be allowed to do any of these things in the first place for this very reason. If a company makes a product and all of your friends buy it and suffer immediate horrible effects from it, are you going to buy it? I'll assume that to be a no. That said do you not think that the companies making consumer goods also realize this? Also, the more power and control government has the more reason a corporation has to exploit it.   • @Leadman1989 More regulations by and large equals more capital a person needs to start a business in anything. Do you think "corporations" really care? For the most part, no. Why? Because it makes it ever increasingly harder for any one to start another company to compete with them. In any case you could hope to present it is almost always better to let the market decide rather than creating regulation systems that in and of themselves create monopolies, thereby eliminating choice.

OSHA is another excellent example of this. They would love to claim responsibility for declines in occupational injury, however, they fail to observe that these were already dramatically falling before their inception in 1970. I agree that we don't need more, in fact we need less. Where has gov succeeded with regulation?

The majority of "crime" in this and any country is because something is made illegal and creates a black market. People aren't getting robbed or "gang banged" over cigarettes or bud lights after all and these are certainly harmful substances...

  • @Leadman1989 Another point on privatizing police would be that they would no longer be a government entity which would immediately dissolve the immunities they have that makes bad behavior perpetual. If one has to face jail time instead of verbal counciling or being "let go to transfer somewhere else" the individual A: would be more inclined to actually know rights better and B: would be far less likely to abuse their position.

  • Supposidly because of the Patriot Act, it is now illegal to take pictures of federal property, police, etc. I haven't read this and I've never heard about this part of the act before. But, in the end, just because a couple dozen cops out of thousands that are messing up doesn't mean that there is a huge injustice out there.

  • basically city cops are guys who had C averages in High School, played football or hockey ( not very well either), enjoyed showering with each other but bashed gay guys, had a nick name that was their name with an 'o' on the end of it, hate natives and Pakistanis, and have a sports team logo tattooed on their ankle....morons...and we give them guns and power...ridiculous.

  • @rconnoly Actually, it's worse than that. I am aware that 11Bs (Army infantry) are flocking to "law enforcement" jobs in droves. As an 11B your skill set consists of "run and gun". These are soldiers who have been repeatedly deployed into combat for 15 months at a time. As the wars draw down and more soldiers are on the streets with badges and guns, we will see many more beatings and killings and they will always have the "law" on their side.

  • @illinoislibertarian The problem is that these are private police! All cities are corporations, therefore, they aren't held liable to the people as they were in the past. Look into it.

    These cities own stocks in other big corporations and make money that way. The board of directors merely see their police officers as a "necessary evil"

    Check into your own city. Check their CAFR (Comprehensive Annual Financial Report) and see what stocks and bonds that they own.

  • @illinoislibertarian Holy crap. You privatize police, and they'll work by their own corporate set of rules the way Credit Card companies do. They will lobby government to set laws that simply absolve them of federal laws since they are a private corporation. You will have zero recourse against a law officer who abuses his power if you privatize law enforcement. Think Blackwater. Only worse.

  • @SecondMarlowe Actually dont fully privitize them just a few regulations. They can only get pay increases if crime is low and punish them if it increases or if there are incidents of neglect and brutality.

  • @illinoislibertarian Fully privatizing them is a superior option. It sounds extreme at first, and that was my initial reaction as well, but I recommend Hoppe's /The Myth of National Defense/. It contains a pretty compelling argument in favor of privatizing the police and the military...

  • @SecondMarlowe Wrong. In a free market, the customer is always right. A privatized police force has a product to sell -- the enforcement of laws -- to a community. If the market is a free one, there will be competitor police forces. A nasty oppressive police force is going to lose on the market to one that upholds civil liberties. Socialized public safety is, like all other centrally planned elements of the economy, inferior to market alternatives.

  • Sometimes police actually think they may get to be federal agents or "work undercover" when they grow up, hence the overreaction. For the most part, they just want one side of the story - THEIR SIDE - to be documented.

  • Jurisdiction is usually "proven" at the point of a weapon, by the municipal "authorities". The most peaceful way of fighting back is either the public lawsuit or the private Commercial Lien. The latter is executed by the one victimized and is usually non-judicial (no judge is involved unless a review is requested). The Lien also is done "Sui Juris" (of one's own law) and does not involve attorneys or lawyers.

  • So this is called "the land of the free". U.S. is no different from totalitarian countries like Iran, or China. Where police can detain the press representatives and civil rights activists for exercising control of the state power apparatus.

    In Denmark, it is allowed photographers to film and shoot pictures in all public areas, as long it is not for advertising. You may broadly shoot who you want, anywhere you want so long as the "victim" is not on private property.

The cops have to inform people of their loved ones being injured, videotaping the shit is just being an asshole. i am not against people video taping when appropriate, but some times people take shit too far.

  • If the cops can film people with camera's in their cop cars that were paid for by tax payers, then we can film them any time we want. They just don't like it when people catch these criminals in uniforms breaking the law themselves.
