Just because the witnesses SAY he was cooperating, doesn't mean he was. I'm sure it may have appeared that way. Keep in mind: This is the Bay Area. I lived and worked in that area for about a year, long enough to know how people are when it comes to the police. (And I worked in OAKLAND, where this happened. I used to see shit like this a lot.) So, I'm willing to bet most of these accounts were biased.
And, even if you're GOING to go by what the witnesses said, many of them also testified to Mehserle's genuine shock after the shot was fired. Why would he be shocked if he actually MEANT to shoot Grant, let alone, KILL him?
As for the Taser confusion argument, I had my doubts about it myself, and still acknowledge the possibility that it wasn't what happened. I think it's just as likely that Mehserle simply didn't mean to fire when he did.

Son, injustices happen from time to time. Everybody knows that. But you seem to be claiming that you would DEFINITELY get "35 years," or "50 years," or whatever, "in the most disgusting part of the prison," when that's not really the norm. Obviously, if you're poor and/or uneducated, you're more likely to receive incompetent representation in court.
I, too, know people who have been in prison. So my input doesn't just come from "books."

Secondly, "incompetent representation" in no way entails that the lawyer in question "never passed the bar exam" or "never went to law school." It means only what it says: Incompetent representation. College graduates and professionals in any field can be incompetent.

Just because the witnesses SAY he was cooperating, doesn't mean he was. I'm sure it may have appeared that way. Keep in mind: This is the Bay Area. I lived and worked in that area for about a year, long enough to know how people are when it comes to the police. (And I worked in OAKLAND, where this happened. I used to see shit like this a lot.) So, I'm willing to bet most of these accounts were biased.

And, even if you're GOING to go by what the witnesses said, many of them also testified to Mehserle's genuine shock after the shot was fired. Why would he be shocked if he actually MEANT to shoot Grant, let alone, KILL him?
As for the Taser confusion argument, I had my doubts about it myself, and still acknowledge the possibility that it wasn't what happened. I think it's just as likely that Mehserle simply didn't mean to fire when he did.

Regardless of whether it was Taser confusion or not, I've noticed that you people don't seem to understand what it actually is. It doesn't mean that Mehserle "didn't know the difference" between the two: Rather, it's the capability that he had, IN THE HEAT OF THE MOMENT, to mix them up, due to nerves, intensity, or whatever other reason. We've all mixed up our keys from time to time; does that mean we can't tell the difference between them?

At the end of the day its tragic what happened and nothing you say, no excuses you make, can justify why he even reached for his taser. A taser is lighter than a gun too. he stood up from his knees holding the gun and stood looking at him before he shot him, its apalling, it really is.

I wouldn't argue with this guy it's useless. He watches a video such as this, and creates a false reality in his head, which then becomes real (better known as schizophrenia), even though there is indisputable video evidence in this case.
He creates a youtube screen name 'Detective' to up his ego, when replying. He claims he hasn't even been to the academy. In my humble opinion, his alter-ego, is half correct. A 'crock' of shite.

and If you were not police officer, You would be sentenced 50 years , with hardcore criminals in the most discusting part of prison.
and Meserhle will be sentenced 3 years in a cell with cable TV good food and he will have visits every day , he will serve 1.5 and be released and start working for police departement in some other city. I know the system.

That's not true. First, it heavily depends upon the precise circumstances of the killing. Regardless of whether you are a policeman or just an everyday civilian, a killing is murder IF AND ONLY IF it can be proven, beyond a reasonable doubt, that is was done intentionally and unlawfully, and/or, in certain jurisdictions (California being one of them), done with malice aforethought.

@Applebaum Simply wrong across the board. This was absolutely unintentional. Pretty obvious to anyone who is not trying to further an agenda. Calling this murder devalues the word. Resistance is met with force. Are some cops racist? Of course. Just like every other section of society. But 8 out of 10 times, when you see brutality, the suspect is resisting, fighting, or otherwise acting beligerent.

Yes, the officer did something wrong. However, he had no intent to kill the man. it is very clear that the officer accidentally used his gun instead of his Taser. But it is more clear that reaching for his gun, standing up to adjust his position, pointing the gun at the target, using his left hand to better hold the gun, then shoot the aiming target, 5 Conscious Actions = First-Degree Murder.
