I dont know if this was ever discussed but that form of pepper spray is banned in some states due to the fact that it is highly flammable. A suspect was sprayed in Los Angeles and then was tasered. As soon as the prong made contact, the suspect engulfed into flames and sued L.A.P.D.
My point is this, if I found this on a person that I pulled over I would take it away and have him come to the jail to pick it up after investigating the Penal Code and researching if our state is leagal or not.
Wylie is strait trash! I love to hear about WPD doing wrong and getting sued. Plano should have annexed Wylie years ago. Instead it turned into a "richer" redneck ghetto. F U WPD!
As an retired officer with 27 yrs experinced, this was a bad arrest. The can stipulates Law Enforcement Stength, not for Law Enforcement Only. If there was any doubt by the Sergeant then seized the can and research the law, let the man go and file the case at large. If the law is vague and not specific then you don't make the arrest. The City of Wylie needs to refund this individual the money he is out of and pay him for his pain and suffering. Would you like this to happen to you? NO!
The officer was wrong and he arrested the right person. A person that stood up for himself and fought against injustice by the Wylie PD. I plan to run for City Counsel in the near future and once I am voted in I will fight for "we the people" and fight against injustices by all including the Wylie PD. I will support Wylie PD if they are right but will not if they are wrong and make bad decisions. I too was a victim of Wylie PD's injustice, I fought them and I won.
Expunge, reimburse Simpkins. More training/Desk job for officer. or better yet, let the officer go. Arbitrarily making shit up to arrest is not an peace officers job description. Sadly, it happens all the time. District attorney should have job examined as well, Waste of tax payers time and money.
@Talhajus for what? can you actually name one thing the officer did wrong. It even said on the can that it was for law enforcement only. hes not a cop, there for hes not allowed to have it.
You are wrong and so was the officer. The can read Law Enforcement Strength, not Law Enofrcement Only. This is a very easy civil law suit to win. The officer did not know what he was talking about and neither do you. Sorry, but the truth hurts. Recommendation: research the law before making a comment.
I fabbed up a similar switch box in my 1968 Mustang. Ignition (switch and button to start), power to gauges, electric fuel pump, windshield wipers. I leave the doors unlocked because nobody can figure out how to start it.
I was unaware that I had to explain the presence of perfectly legal items such as this to law enforcement officers.
While I won't agree with the arrest...I do still wonder about all the gear that seems kinda strange in that truck. What do you have a scanner, all the light switches and speaker box for? I think those items sure make it seem a little suspicious (playing police sometimes maybe?).
Well, scanners are NOT "required". I'm sure they might be helpful. And you say "used to"....and the scanner is still there because? And this freelance media story doesn't explain the switch box either. I'm just saying, if I stopped you and saw all that in there, I would probably look a little harder as well. I wasn't there, I don't have the full story...just my 2 cents.
In the freelance world how would you know what call to go to if you didn't have a scanner. I did not have a dispatcher. The switch box runs all the electronics. 1: fog lights 2: radar detector 3: gps mirror 4: gps 5: rear back up camera. I completely understand the stop but when I explained it didn't matter. They had there minds made up.
@dalman34 The thing is, if after being explained some of the circumstances you still cant come up with anything illegal or REASONABLY suspicious that he was doing.... if you cant do it after actually talking to the guy then the cops probably couldnt have assumed he didnt something wrong just by looking at him.
You say scanners arent required, but the only thing that matters is: Are they illegal? No? Then a cop has no business hassling you about it, thats how the law is supposed to work.
Haha this guy totally wanted to be a cop, failed, got arrested and now hates them. Even goes so far as to record them doing their job like a douchebag. Mr. Simpkins, you're pathetic. Go back to your parent's house and play with your helicopter toys. Leave the REAL men alone.
Man...you can even tell that the cops were looking for anything that would "justify" the 40 minutes that they spent with you. So the cop pulled that "law" out of his ass...sooooo unfair :[
People can own armor-piercing bullets, but not this? Don't the cops have anything better to do? Who was robbed or raped while they spent 40 minutes on this bullshit? This is TEXAS?
Saw your ad on craigslist. What a crock! That cop doesnt even know the law. Ill bet you cant find a can of pepper spray that doesnt have Law Enforcement Strength printed on it. That is just a marketing gimmick.

Well, the officer who claimed the law had been broken was right. He just had the wrong person being arrested for breaking the law.

Per my attorney I can not comment but I will say this.
I used to do freelance media for several years. Scanners are required.
