  • what is being said here is that these people are not going to jail over there debt but there debt lead to the court getting involved which gives a court order for the person who owes money to appear in court and if the person does not then they are arrested for being in contempt of court and i think that is the point being made. debt prison went out in the 12th century i beleave so you can't go to jail BECAUSE of the debt but that debt can lead to other actions that lead to your arrest.

  • @ianchard my mistake you are indeed correct. soon after seeing your comment i was confused until i read the last part. forgot that scrooge himself had said that he gives money to the work houses *day labor centers by today's standards* and the debtors prison.

  • if u have a debt that is handled by "court" all you have to do is show up for your court dates..u miss a court date u r found in contempt and u get a warrant..if u have the money to make a payment on ur debt and u dont u can also be found in contempt

  • @jeffthecoder once again...not true...you get what is called a "default judgement" entered against you...it goes on your credit report....if you don't not pay it...the lawyer can file a "wage garnishment" or "asset levy"...you cannot be put in jail  ......

  • @usmc2076 whatever u say usmc..i speak from personal experience..cops ran my info one day and (acting confused) took me to jail..i was officially arrested for a bench warrant due to "contempt of court" and it all began with a company wanting to sue me

  • @usmc2076 so, as i said before, if they subpeona u to go to court (not including companies who use arbitration which is what u were talkin bout with the credit ding) and u miss court, or if the prosecutor can prove that you are unwilling (as opposed to unable) to make payments on a debt u can be jailed for contempt of court

    Yes you can be jailed for debts. Its a nuance in state law like in Arizona. But its against Arizona's constitution and the Federal FDCPA law so their is a conflict.

    Learn your rights, so when they violate the FTC, FDCPA, FCC laws, you have a case against the debt collector. I am NOT afraid of debt collectors, nor should you be, and being in debt DOES NOT make you a bad person. Laws protect you from third party debt collectors whom you did not enter into contract with. Stand on these laws, and collectors are HELPLESS, yes helpless.

  • As I suspected there appear to be some ommisions here. You can be arrested for issues related to debt like not showing up to court when summoned or not complying with court orders but it seems unlikely -at least as of right now- that you can be locked up for simple failure to comply with a civil contract. Assumimg there was no malice or ill intent or other special circumstances.

  • You are absolutely correct! This whole thing is very scary. I read more and more about people being jailed for not being able to pay their debts. They don't care if you may have a debilitating illness or if you got laid off causing you to have absolutely no income for a while. They are soulless, and they are putting people in jail for being sick and/or having no job. If a person doesn't even have enough money to eat, how can they pay any other bills? Jail is not the answer, THAT'S for sure!

  • do as I do. when I got cash I eat. when I dont have cash I dont eat. sometimes its a day or two without food...especially those times when rent is due...but at least Im not running the risk of going to jail...i want to be a school teacher someday! i cant have jail on my record. so better not to have credit. not to trust banks and put my cash under the mattress.

  • Ok, first of all, when a creditor sues you for money recovery they sue you in civil court, which means that the State Attorney is usually not involved. They are suing you for damages. However, I am willing to bet that a lot of the people that you speak of, if not all, had warrants issued because they failed to appear in court when they were summoned. So, the court not the dumb fucks at the collection agency, but the court held in them in contempt and as a result they were arrested.

  • You are terribly misinformed. She was held in jail for being in CONTEMPT OF COURT NOT FOR BEING IN DEBT. She ignored a court hearing about her debt just like she was ignoring her payments she owed. She had not made any payments in years!

    Credit cards are not "free money". You have an obligation to pay; the creditors have an obligation to collect. If you're both doing your part there shouldn't be a problem. If you have debt, pay it. If you can't pay it, seek help before it gets out of hand.

  • No that's not real, you can pay your bills with A4V process, in this country you can not go to debtors prison, Google A4V ,you need to figure out who you are, your not a legal fiction, all capital name, a third party can not collect money owned on a contract.
