Actualy, now that I watch the video again, I don't think that Josh was so drunk that he didn't see the flashing lights. I think he's trying to speed up at the last second to get in front of the car to his right. Watch it a couple of times.

You can also tell that that is for sure the accident because the car that was traveling alongside Josh sped up in order to avoid what probably sounded just like a loud bang to them, probably their gut reaction was to speed up to avoid the loud bang if it was an accident, and then the car or cars behind Josh started to slow down.

If you keep watching, starting from 1:10, you can see two pairs of headlights, however, the two reach the tow truck and only one pair of headlights keeps on going down the road. If you look closely enough, you can see the tow truck kind of shake a little.

It seems that the car to Hancock's right is blocking him from changing lanes. The car to the right is slightly behind Hancock. Even though the accident happens in full view, he RACES UP, not slows down. If you "go big screen" you can see Hancock's car comes clearly into view at 1:10-1:11 (full speed) and 1:48 (slo-mo). Accident happens at 1:14 and 1:54. Car #2 is a witness, Hancock had no chance to swerve out of the way.
