@emcegriddle Yes em.... but if you take it back to Apple and tell them you bought a used ipod... they can run diagnostics on it to see if it was infact jailbroken before it. They'll give you a brand new Ipod touch in the newest generation. Hope this helps and good luck.

I was happy with my iPhone from the beginning.. After I jailbroked it, i loved it 100 times more.

I had my Ipod touch jailbroken, then when i updated it broke and i was stuck with a picture of steve jobs saying something in russion... and i couldnt do anything on it!

so in the end i had to restore back to factory settings, then load all my songs and stuff back on and it was a real pain..

I wouldnt jailbreak again.. you get sick of the backgrounds after awhile, it tends to slow the ipod down, and consumes precious battery life! Not really worth it...

Apple is makeing an update the friday thats coming and u can do EVERYTHING u can do on a jailbroken ipod (accept u cant get free apps) but u have such a great things u can do when u update it the updats thats coming! go to apple.com and clike on ipod then ipod touch and IOS 4 update clike on that read the features it has!

@farhadcarl619 jailbreaking is completely worth it and you are wrong. ios 4 cannot do everything that jailbreaking can. Also, once you already have ios 4, you can jailbreak that so u have the newest apple update and more capabilities from jailbreaking. ALSO, if you do not have an iphone 3g s, then you will not be able to get multitasking with the new update, meaning if you have an ipod or an iphone 3g, u wont get the new features

@ZAMtech1994 the new update DOES do everything and its available to people with iphone3g,iphone 3gs , ipod touch 2G, ipod touch 3G ( for iphone it has to be higher then 16GB) and for ipod touchs (it has to be 32GB or 65GB) ONLY and again yes it does do everything jailbroken ipods can (accept free apps) go to apple.com and on ipod touch section clike on IOS4 and read everything on there

@farhadcarl619 no it doesnt do everything that a jailbroken iphone can do. you cannot get animated backgrounds. and people who have ipod and iphone 3g get the update but do not get multitasking. you need to look up ur facts before you start talking. if you read anywhere, it says that ipod touch and iphone 3g do not get all the features from ios 4. ALSO, theres no such thing as a 65gb ipod touch.
