  • Police in most civilized countries (USA, England, etc) don't do "random" house checks unless there's a registered sex offender in residence, or there's probable cause, or the resident is acting in a viably suspicious manner. If you're not conducting yourself in an unlawful or manner as to disturb civic order then you don't have anything to worry about.

    Unless you're doing something illegal, or making a nuisance of yourself then YOUR NOT THAT IMPORTANT.

I have a friend who is a criminal defense attorney and everything they say here jives with him, but the best way to stay out of trouble is to not do illegal things. I have been pulled over for speeding on more than one occasion, (I used to have a bit if a lead foot.), and never once did an officer want to search my car. No one has ever shown up at my house for a "routine check" or whatever they said here.

If they don't have a warrant and you explicitly state that you do not consent to the search you can shot them if they try to enter by force, provided that you legally own fire arms. For all you know, they could have been thieves or rapists disguised as cops to lure their victims. They where not acting lawfully after all, they where clearly not real police officers. IANAL, your mileage may vary.

I live in halifax nova scotia and it is illegal to search the trunk of a car without a warrant but cops do it on a regular basis just to take anything they find and destroy it. Even if you flex your rights there is little you can do if a cop simplys lies.

  • @macronewb There are numerous legal ways for a police officer to get access to the trunk without a warrant. If the officer finds drugs in the vehicle, beyond an already burnt joint (i.e. nothing left but odour), the cop has access to that car, bumper to bumper (in Canada), and you can be detained/arrested. I don't doubt some cops do breach people's rights and "push their luck", but if they check your trunk and seize/toss your weed, what are you left to do? Complain about your drugs being taken?

    I know you posted a long time ago, but I noticed during this time that people where practically running down the ally in front of the officers canvasing the neighborhood. People who like you must have thought the cops where there specifically for them.

  • It depends... I was at a huge house party 2 weeks ago where the police showed up due to "hearing us as they drove by." The house was in a fairly rural area up in the mountains, and there was no formal noise complaint filed against us. Everyone stayed inside and someone over 21 met the police outside. Because they could not see any underage drinking going on inside, (<<this is the key, can't see can't enter!) they could not come in. They just told us to keep the music down and left us alone.

Regardless if they have a warrant or not, if you're not expecting the police to show up at your house or if they show up uninvited, you have every right not to open your door. They can leave you a note on the door or in the mailbox and if they've got a warrant, you need not open the door anyway because they're coming in regardless. This is easy to remember. Just NEVER open the door for ANY uninvited guests...EVER.
