You have no duty to retreat from Burglars in Texas. Also, the Penal Code allows DF to be used in defense of property, even third person's property. Lastly, if you are familiar with the police officer's testimony, he stated the criminals ran towards Joe Horn and only veered away after he shot. Joe had self defense AND defense of property going for him. He wasn't indicted. End of Story.

Joe Horn was NEVER told there was an officer on the scene before the shooting. In fact when dispatch told him they had officers on the way, Horn was emphatic when he said "they're not here yet". Immediately afterwards, Horn went outside because the burglars had exited the window with a "bag of loot" and STILL no officers were seen. Horn was only told officers were actually there after the shooting took place. All this information was skillfully presented by both the prosecution and defense.

You have no duty to retreat from Burglars in Texas. Also, the Penal Code allows DF to be used in defense of property, even third person's property. Lastly, if you are familiar with the police officer's testimony, he stated the criminals ran towards Joe Horn and only veered away after he shot. Joe had self defense AND defense of property going for him. He wasn't indicted. End of Story.

Joe Horn was NEVER told there was an officer on the scene before the shooting. In fact when dispatch told him they had officers on the way, Horn was emphatic when he said "they're not here yet". Immediately afterwards, Horn went outside because the burglars had exited the window with a "bag of loot" and STILL no officers were seen. Horn was only told officers were actually there after the shooting took place. All this information was skillfully presented by both the prosecution and defense.

Concerning these two burglars, I have to say the chances are better then 50/50, that if Joe had not stopped their burglarising spree, they would have broken into an occupied house by now and would have killed the occupents! Afterward they could have ran back to Columbia, and we would still be looking for them. The lives that Joe saved might have been your relatives! Killing vermin like these two is a GOOD thing. Having had my house broken into before, I have no sympathy!!!!

My thoughts on your post is - Do not look at it from a moral perspective....look at it from a legal point of view. Texas law, 2nd amendment, grand jury etc. All side with Joe Horn (Just MY opinion along with the courts).
