Coming from Law enforcement..... I support the right to bear arms as much as anyone. My only issue with carrying my firearm openly is that if i'm standing in a gas station line and someone comes in to rob the place and sees my gun then I become threat #1 and target #1 to them if they start shooting.

The (e)check is usually brought about because someone saw you carrying, got scared, and called the police to report a "person with a gun". If they get a report, they have to check it out. If they don't get a report, they don't have to do an (e)check, but they still can if they want.

@Ferni33htx In Texas, you need a permit to carry concealed, and it's against the law to open carry. In California, you need a permit to carry concealed (which they won't give you), but you can open carry without one. I agree that requiring people who open carry to do so unloaded is stupid, but it beats not being able to open carry at all.

It is very constitutional to check someones firearm who is exercising open carry. Remember how the constitution allows states to have their own individual laws....that's what the penal code is. furthermore this search does not violate your right to unreasonable search because it is reasonable to believe that not everyone exercising open carry is doing it lawfully with an unloaded weapon.
