  • By the way, the story i told....its a true story, happened to a family member. They sued, and won, but it took 5 years in court. I personally was ripped off, but i was never able to prove it. Patents dont protect you from Billion dollar companies, u have to be able to defend the patent which takes huge resources. I can see why people dont want to invent anymore.

  • He's right, it happens all the time, but sometimes for reasons you wouldnt think. Eg; Your a buyer for a big retailer(say 10yrs) your fired if you cant bring in the "next big thing" and increase profit margins. Inventor has a meeting with said individual, shows idea, gets ripped off. Ripped off for several different reasons, buyer needs your product, but your price is too high. Buyers response, ripp off, send to China, BANG! instantly doubles margins. Buyer is a hero, keeps his job.

  • In my opinion is that patents cost too much also. Someone spends a lot of time and money on something they make only have to spend several grands on a patent.

  • engineer and inventers should band together and make there own Inventions with having to go any to company to distributed.

    I made a Cool LED WORLD MAP MACHINED OUT OF METAL. and a canadian flag version too. I made it to hang it on my wall to inspire me to create art and to show people how its done. When i make something, i get bored of it and move on to the next idea

  • @JMEMantzel Jamie, I know you dont want to get into a legal battle, but by not doing anything, you are not fighting them. By doing something about it and not just laying back, you are showing them they cant just steal your ideas. Also, consider that just the threat of legal action might not make them stop, but might settle. If you can prove its your design I really think its foolish not to go after them. Its worth it, and you will stick it to them.

  • @louisiukas I'm not one to start fights, but... I'm all for making the truth about things known. ...and i can prove I invented it way before they even claim to have.

    Its total crap, and the fact that big businesses go around pulling crap like this all the time makes me vomit a little.

    I'm just waiting for them to sue me for making them. That would be the icing on the cake.

  • I wonder if major companies treat their relationships with Chinese manufacturers like a leaky sieve. Instead of getting one good idea and then resting on their laurels, they instead keep topping up the sieve with new ideas and upgraded models (ie: planned obsolescence, horrible i know).

    There's so many leaks that to stay afloat you have to keep feeding the beast new innovations and new releases. The moment you slow it down, someone will get one of their (YOUR!) stolen ideas to market b4 u can

  • this is probably going to sound really amateur... I think having a laser pointer built into the head would be amazing... bi directional. Reason being... Everytime I have owned a laser-pointer (especially the blue ones) I have played with it constantly... maybe it's just me, but anything with a laser= timeless fun (or something like that)

  • jamie: I'm a software developer and I've had source code I've written and donated to the community turn up in abusive non-free software, and its heartbreaking. But never give up inventing stuff. At some point some kids going to open a present and pull out your officially aproved spider-tank and he'll be the happiest kid on the planet, and that makes dealing with the crap all worth while. Stay positive man.

  • Have you considered some sort of inventor community activism? If this sort of injustice is as prevalent as it sounds, it seems there'd be interest in a group to protect original inventors (heck maybe it already exists). The group could protect the original inventors by promoting consumer awareness (some sort of "The original!" sticker maybe) and potentially through group legal effort.

  • you should have used your design and sold a children's version. you can perfect it in v2.0 .... on the flip side, you can get an awesome lawyer and sue everyone of these bastards for infringement and get some money back for your idea.

This is the first one I feel compelled to comment on because I definitely understand the frustration. I think, just for your own inner peace, it's definitely best to let it go, but I want to respectfully suggest that in this case...

  • although I agree completely with what you're saying about Western culture, the source of the treachery concerning your robot design is almost certainly a Chinese factory. The American patent system certainly isn't perfect, but it's based upon the idea that we have a right to our ideas-- that we have a right to own them and have some measure of control over how they're used. China doesn't recognize that right. They don't have patents, and they don't enforce...

  • American patents or intellectual property rights. This isn't meant to be an accusation-- it's something China is open about. They think it's wrong for ideas to be kept by the people/companies that come up with them. Since your robot is being manufactured in China, it's much more likely that the idea was stolen by a manufacturer there than by an American company that is subject intellectual property laws (even if those laws aren't perfect).

  • I've had some personal experience with this myself several years ago when I worked for a wig company. (This post is already running over several comments, so I'll have to save that for in case you're interested in hearing a story about sneaky chinese wig factories. Suffice it to say, while we were diligently sending prototypes back and forth trying to perfect a design, every month some rep from another chinese factory would show up with a shoddy copy of the last prototype we'd sent back...

  • trying to sell it to us as if they'd come up with it, even before we got the revised version from the factory we were dealing with. We got so disenchanted and disheartened with the process that we finally gave up on the idea of having them made in China after about 9 months of work.) Just visit Chinatown in New York City and walk down Canal Street-- you can't walk ten feet without someone offering to sell you cheap knock-offs of almost every possible product you can think of.

  • I'm with you on the sense of honor. That would be the only real solution to these things, but unfortunately we can only control our own sense of honor and not that of others. In the meantime, it's still worth respectfully discussing how this stuff happens. So, I thought I needed to shed some light on which culture, in this particular case, is most likely to blame. I don't intend that to be an attack on ANY culture, it's just a matter of one culture not valuing the origination of ideas.

  • There are many lessons we Americans could stand to learn from the Chinese, but honor in intellectual property issues isn't among them. The only reason I felt compelled to comment is because I'm anxious to see your toy come to fruition and want to encourage you to be watchful... if it's possible to do that without submitting to cynicism.

  • amen. i spent about a year on a tool holder for a metal lathe only to have a co-worker steal it and patent it. you really need to be careful with who you trust.

  • i tried to sell my idea to people instead of patents, that way if someone trys to steal it at least you got some money out of the situation

  • Hmmm... I might mention that about half an hour ago I designed..... the SPIDER TANK, MARK 6!!!! :-) Tee hee. I got an idea that changes the entire mechanism into something even better.

    The one is this video was only the 4th...... and its still way better than anything I've seen out there.

    Hmmm.... now I've just got about 5 days to build it... err... early night tonight. :-)

A friend once told me about his system of dealing with it, he said, "listen, people will constantly rip off you, constantly, the better you get the more you have to expect that, but that doesn't mean you stop. it should force you to keep producing at a prolific rate, because aside from the dishonorables there's a cast of people paying attention and considering a future with you." not creating vs sharing. do both

  • We need more engineers, inventors and artists running this country rather than lawyers. One thing that would help is a constitutional amendment to limit how long bills are to about 10 pages and make it stick to the subject. Thus more people will actually read the bill and at the same time SAVE A LOT OF MENTAL ENERGY FOR CREATIVE PURSUITS like what you're doing. Also, patent laws as I understand them, are stultifying innovation. They've got to go. Keep doing what you're doing!!

I have gone there for a few years now and am still blown away by the inventiveness and creativity of the people that go. whether its an art placement , an art camp or an art car vehicle, it's all done not for money but for the sheer pleasure of making other people smile.You should look into it.

  • I completely agree. These ideas of Morality and Ethics need to be emphasized in school systems and business practices. There are many great lawyers and business people that have a good moral grounding, but it feels like they're outnumbered by the scumbags. I really like the way that your cutting against the grain here, and I support you. Oh, and there's plenty of schysters up here in Canada too...the world just doesn't know it yet...

  • Been an inventer my entire life. I shelve 90% of the stuff that I invent because I know that it will just be stolen, and I don't know jack about how to protect it (assuming that it is even possible).

    It is always gratifying/depressing when I see my inventions on store shelves 10 years later. Gratifying because I know that it worked. Depressing be I'll never see a dime for it.

    I have one now that I'm going to try to market, just because I already know what happens if I DON'T try.

    Which is why I've decided to change.

    If I shelf my inventions, I already know that I will get nothing. Atleast if I put them out there, there is a chance that I will get something.

    As for the advancement of technology bennefitting the human race... dont' kid yourself. Look at history. Almost all technology ends up being misused or abused generally. Yeah, it makes more things easier/possible. But 90% of the gen pop will take that opportinuty to simply do less :-(

Then social standards start being set around all of that crap. So now people have to buy all of this crap just to fit in.

    So is technology good? Yes, but only if used correctly.

    How often is it used correctly? Not nearly as often as it is misused.

  • @hakachukai I don't know if blaming the entire endless-consumerism-at-any-cos­t paradigm on the advancement of technology is fair, even without innovation, things get re-hashed and re-labelled and sell just as well.

    As I see it, innovation adds to the human knowledge base, which is good. Whether it is used for good or bad is a societal problem, which isn't really in the hands of innovators. You can strive for positive change societally, but not innovating isn't going to make society better

    For example:

    How do you think Jamie would feel if after the Giant Robot Project was finished, he found out 6 months later that terrorists are now making them out of scrap aluminum, and using them with weapons upgrades to rape and pillage helpless villiages.

    I've heard that Einstien bitterly regretted helping with the Manhatten project, once he realized what it would be used for.

  • @pdxtone I agree. the internet IS a powerful tool. Its an amazing way to pass information around about sleazy business preactices. I've learned about loads of businesses that I avoid. ....and usually, i first hear about them online.

  • I hate to say it, man, but strong innovation is only one part of a successful product launch. Engineers rarely understand this. They think that the only important skills are the ones involved in building the product.

    But what you are trying to do is get the product from your brain to some kid's hands. You can build the thing -- that's 1/3 of the trip. Operations, logistics, marketing and legal are going to take it the rest of the way. You had better fill out your team if you want to succeed.

  • @JMEMantzel I'm not saying it's the only way to do things -- I'm explaining a common pitfall. It is just as important to know how to implement (i.e. get your product to market) as it is to know how to invent.

    If you don't like the way business currently works, do it another way. I am just trying to make you aware that the best engineering is not a clear path to success. Just ask the guys at PARC (who invented the graphical user interface and the mouse, before Steve Jobs stole the idea).

  • I have to be honest JME, my beliefs in inventions are exactly the opposite. You should share your inventions, to make the world more awsome. If it werent for patents the would be much more efficiant and safer.

    Both realistically and genetically speaking what you want is to be successfull enough so that you have a springboard onto the next big improvment, its good mental training and people who steal never really have this. But you don't 'own' the ideas, their potential alwayse existed.

  • @JMEMantzel Well, you can't help it once your at the marketing stage, the idea is out there at that point. But you can keep it hidden until you hit the marketing and production phase :)

    I've seen a few people loose good idea's, toy or game related... its rather heartbreaking, but it happens.

    Product of a profit driven system I suppose.... :(

  • @JMEMantzel No, you get some sort of protection on it before you show to anyone. My father got his product patented for under $3500.00 USD. Now he can show to anyone and carry it to any trade show without having to worry.

  • @sniggityOK, so maybe i don't have 3500$ lying around. ....and patents don't protect you unless you can defend it. (byt adding a few zeros to that number. ....like 350000$)

    A lot of businesses won't even defend a patent. Its so time consuming, and difficult to defend it against anyone with endless money.

    Anyway, this video isn't about who can legally get one up on who. Its about personal honor, and how its non existent in our business culture. Perhaps I should have made 2 separate vids

  • Been there, done that.

    Dont go to China if you dont want your things been copy. That is what they do. When did you see something that was invented in China? They are cheap because they dont need to spend money on development. They know people from all over the world come to them with greate ides. They run over to the factory next door and have it made as there "own" thing for 1/10 of the price.

  • When your toy comes out and the quality is supremely superior, the makers of the crap walking toys will cower in fear... and if not from that, then when your army of sentient giant walking robots comes after them.

  • I know how you feel man, i used to be a freelance 3D artist but the amount of times i saw my work with someone else's name on it some were even selling my models as there own, in the end drove me to quit.

    Many people don't realize how demotivating it is.

  • Please don't patent your stuff (but keep a record of the invention process). Your video has demonstrated that patents are ineffective for small-time inventors, and it'd be nice to be able to build on top of cool stuff without having to worry about patents.

Your voice shakes when you say that you hope that they didn't rip you off. Hire someone to do the negative thinking for you, it's ok to assert your rights, it's cool to pay for services that you need.

  • i HIGHLY recommend you pitch your toys in person! at a show like toy fair. The toy industry is competitive however they usually do not deal in patents and any noteworthy company does not steal ideas, it's a trust based industry. thats no to say there are not companies that don't scam they are simply not that important (small low quality)

    You are a talented designer don't let this hold you back. i have gone to toy fair and pitched before, pm me if you want advice

  • Disney stole the whole story line and characters for the clown fish movie from a French author who sent it to, guess who? He sent it to Disney and they rejected it and sent it back. Later they made the movie. The French court did not stand up for the guy, either. Disney is very popular in France and there is the theme park, too. The author was basically sacrificed by the court.

    If you have imagination to make toys, you need to set up a company. Good luck. You are inspiring.

  • @Joeey The other way to deal with such bullcrap is for all of us individuals to spread the word when a company is being really really shady. I won't support any company that screws people over like that. The individual consumers are the ones with the real power here.

  • ..continued. Also if you or a friend has invented something already but you can't think of a way to make money off of it surely there is value and pride in simply showing the world what you've come up with and allowing others to run with the idea and use it in new and unique ways?

    I understand the argument that says "If I can't make a living inventing things then I can't spend time inventing" but if you've already have an invention and don't know how to profit why not share it for the world?

  • @davyjames I do agree with sharing invention just for the sake of it. ..and thats what I do with most things I make. Seriously, though... its frustruating to always be building things with garbage because I can't afford to buy materials. If I got revenue from 1 or 2 inventions, I'd be able to make so many more things.

  • The problem is suits have no imagination, and few brains. They only hire people with degrees. Degrees whip all creativity out of students. Suits end up with an army of degree holding, unimaginative people, but no creativity in their organizations. The suits refuse to hire the creative inventors because they do not have degrees. The organizations have nothing to sell that is not stolen.

    Suit solution. Steal as many ideas from unqualified inventors after refusing to hire them.

  • Hey man I can feel your frustration and I think it's a shitty move for somebody to steal your exact idea.

    That said, I don't think ideas can belong to anybody. Once you've expressed your idea out loud to another person to stop them using that information to create their own things would be to retard their own knowledge. Imagine if Mr. Ball bearing came to you and said "You shouldn't use that. I came up with the idea."

    Wann say a bit more so I'll continue in a second...

  • Yeah you did show it in easily enough detail to work out how it works. I could certainly recreate it (very clever design btw).

    It sucks, but I think you can beat them on marketing and quality. :-)

    The guy who invented the intermittent windshield wipers shopped them to the car companies. Who refused to use it and pay him but then stole it. Finally he sued and won.

    This is like a woman being raped and not filling charges because she can't face the trial but then the rapist is able to rape other people. When inventors don't sue, it gives the thieves permission to steal more inventions. SUE!!!

  • So true about the money thing - As an outsider, I'm sure the US would achieve a far mentally healthier population (and generally better-off) if the culture became less obsessed with the idea of money/possessions = success

  • Jaimie - it certainly sounds like people are/have copied your idea. When you refer to "culture" in a negative manner are you singling out the U.S. culture? It kind of sounds like you are, and wishing we could be more honorably like the Chinese. The Chinese have no respect for intellectual property and they may, in fact be the ones copying your design. I don't want to point fingers either, but it is certainly possible.  China is the king of industrial espionage.
