I think Apple is having a hard time compete specially with the fact there is a risk of them losing the right to sell their products in USA!

You made some good points but a few issues.
1. I think the company that had the iPhone name settled.
2. If coke used the exact same ingredients as pepsi and called their product Koke don't you think there would be problems?
3. Apple waited for a very long time to sue Psystar, so I don't think thats and indication of anything.
4. I think all Apple has to do to shut down the google phones is settle out of court then open the iPhone up to Verizon.
