This is the case across the country in a myriad of situations where a need to set a standard of excellence is established to suit the needs of the general public, an attempt to implement that policy is issued and has to be revised or dismissed all together because,namely blacks cannot meet those standards and civil action is threatened. Depends on the context, if the wise white male is a member of a un empowered minority ethnic group, and this white male is ruling on a decision that affects white males disproportionally in an environment ruled by latinas, then it may not be racist. The white male experience may not be understood by the powerful latinas who've never seen it realistically rendered on tv or who may not have many white male colleagues, acquaintances or friends; a white male may make better decisions in this case

There was no viable alternative to the exam that was given. That confers FULL PROTECTION UNDER TITLE VII.

This shows (is substantial evidence) that New Haven was never liable under Title VII until they unnecessarily revoked the exam. The law was always clear. Sotomayor (and Judge Janet Arterton before her) misinterpreted it.

Exactly. If the standard could be proved to be fair and necessary for the general protection of the public,then anyone regardless who could not meet these standards are just not considered. Once the slandered is legally adopted,then liability is a concern only in matters where the standards and policies are not applied equally.

She was speaking about past white male justices on the supreme court, most if not all of which have come very privileged backgrounds.

Those backgrounds may make it difficult - but not impossible for them to understand someone posse sing a different gender and having very diff life experience.

She followed that statement , by saying that in spite of that , past Supreme Courts had made decisions that were progressive for minorities and for women. Her point tho is still valid.

The wise latina comment was in response to a question that was about issues that concerned poor women of color. Now what she meant was a wise latina might make a better decision because she may understand that persons background and their situation better than someone who presumably "hasn't lived that life", they, being white males would have never been female and since they may be from a privileged class may never have been poor. She graduated from a public school system that did not prepare her as well as her private schools that I assume many of her peers at Princeton had.

She mentioned being the only person in her neighborhood that had an encyclopedia. Encyclopedias are expensive, most people in poor communities cannot afford to make the extreme sacrifice that buying a set would cost.

I'll admit that past hearings may have had questions being asked solely on the basis of politics by both sides. But some proposed nominees legitimately deserve serious questioning, ex Robert Bork, who argues against living constitutions . His argument would see the reinstatement of slavery, and reversal of constitutional amendments since the original draft. The man is a kook. Harriet Myers , Bush's cleaning lady reviled on both sides. these people deserve serious questions.

The SCOTUS established a new standard to this case; hence, it created new precedence or law.

So if the US legal system is based on precedent and not legal principle as the French Legal system is, then all this talk of judges not making law is ignorant poppycock.

Also life experience does matter, in many instances the facts of trial cases as presented to the court makes an up or down decision difficult. Insight into the situation via life experience helps

All this talk of judges not making may in part stem from instances of real judicial excess, but it may also stem from the disappointment some groups may have with legitimate decisions made in some cases. I'm not American or a lawyer so I don't know for certain. It just seems to me, the anti legal activism argument is just sour grapes.

I'll admit i'm no fan of Clarence Thomas. At his confirmation hearing serious allegations of sexual harassment and offensive behavior were leveled against him. These charges demanded investigation. Sonia Sotomayor has charges that are laughable at best levelled at her. These charges stem from the GOP's need to satisfy their base ( or R. Limbaugh).
