@alanah121 What I am saying of course, give a serious interview to a serious person trying to be appointed to a serious post. But I think the questions should be serious, not words taken out of context or scurrilous accusations of racism.
I think every professional congressperson should act professionally and not like a three year old child trying to "splain" nonsensical ideas. She is a racist, etc.
I think the congresspersons that did that would earn more respect.
This is the case across the country in a myriad of situations where a need to set a standard of excellence is established to suit the needs of the general public, an attempt to implement that policy is issued and has to be revised or dismissed all together because, namely blacks cannot meet those standards and civil action is threatened. In this case,as all may be aware several white fire-fighters lost positions to blacks steming from this degrading of standardization.
she ruled against white firefighters who did not come from a priveleged background so i guess she doesnt really understand the common man afterall . so much for life experience when you are a bigot
i would hope that A wise white man with the richness of his experiences would more often than not reach a better conclusion than a latina woman who hasnt lived that life. (does this sound racist? )
Depends on the context, if the wise white male is a member of a un empowered minority ethnic group, and this white male is ruling on a decision that affects white males disproportionally in an environment ruled by latinas, then it may not be racist. The white male experience may not be understood by the powerful latinas who've never seen it realistically rendered on tv or who may not have many white male colleagues, acquaintances or friends; a white male may make better decisions in this case
Wow. Sotomayor STILL doesn't understand the case she botched.
Theres nothing new about the idea of "substantial evidence. What other kind of evidence is there?
There was no viable alternative to the exam that was given. That confers FULL PROTECTION UNDER TITLE VII.
This shows (is substantial evidence) that New Haven was never liable under Title VII until they unnecessarily revoked the exam. The law was always clear. Sotomayor (and Judge Janet Arterton before her) misinterpreted it.
Exactly. If the standard could be proved to be fair and necessary for the general protection of the public, then anyone regardless who could not meet these standards are just not considered. Once the slandered is legally adopted, then liability is a concern only in matters where the standards and policies are not applied equally.
questioning someones prejudicial attitutes before they are placed on the supreme court is not laughable it is their charge and the assumption that white males come from privileged class shows the same bias
She was speaking about past white male justices on the supreme court, most if not all of which have come very privileged backgrounds.
Those backgrounds may make it difficult - but not impossible for them to understand someone posse sing a different gender and having very diff life experience.
She followed that statement , by saying that in spite of that , past Supreme Courts had made decisions that were progressive for minorities and for women. Her point tho is still valid.
no one is saying she is stupid........just racist. She didnt say she thought she would come to an equally just decision, she said better. She obviously prefers to side with minorities and will search for precident to support her agenda while she smiles and claims to be impartial. The sad part is that she will be confirmed and we will be the poorer for it. And in 2009 citing slavery and social injustices from the far past as a rational reason to be unfair to any group is wrong.
The wise latina comment was in response to a question that was about issues that concerned poor women of color. Now what she meant was a wise latina might make a better decision because she may understand that persons background and their situation better than someone who presumably "hasn't lived that life", they, being white males would have never been female and since they may be from a privileged class may never have been poor. So those ppl may not understand issues of those poor females.
Normal blink rate is approximately 12-20 times per minute. Being on TV (lighting, etc.) raises the rate to 40-60. Stress (especially in non-truthfulness or evasion) raises the rate to 80-100+ range
Maybe if some of the judges in the PAST would have been a WOMEN or BLACK they would have had the empathy to understand that women needed to be treated as equals and that slavery was wrong.
Those judges followed the same constitution written by slave owners and racist when considering how blacks and women should be treated
The start of America was just like having a recipe for a cake. The Constitution was the ingredients for the cake and the founding fathers fucked that up big time.
When you take it out of the over it looks great but once you take a taste you see how fucked up it really is....
Something created by a bunch of slave owning, women beating, racist
If you're not a white male please understand THE Constitution wasn't written to benefit YOU
Jeff Sessions is one of the few good ones left in that cesspool called Congress. Sotomayor is a liar. She rehersed her answers and is telling them what she thinks they want to hear. She is a quota queen, a racist of the 1st order. A member of La Raza (The Race). The Dems even gave her their questions before hand and told her how to answer them. She's just another an affirmative action dumb ass. Needs Govt handouts to survive.
Let me type..slooowly. She.. graduated..summa cum laude.. from..Princeton. That..is..not..a..government..handout. That..is..excellence. As..for..the..democrats..giving..her..their...questions..beforehand
thats ridiculous. Are you five? Where do you come up with these things?
And yet she herself claims to be a baby/result of affirmative action and even talks about her grades being lower then her peers at Princeton and Yale or in admissions.... grades aside - are u listening to what she's saying?
She graduated from a public school system that did not prepare her as well as her private schools that I assume many of her peers at Princeton had.
She mentioned being the only person in her neighborhood that had an encyclopedia. Encyclopedias are expensive, most people in poor communities cannot afford to make the extreme sacrifice that buying a set would cost.
Yet in spite of all these disadvantages she still outperformed her peers. affirmative action gives chances tht background woudnt allow
they have to be nice, their objections are ridiculous so they can't trumpet them loudly.
Also being mean will alienate a key voting constituency. They should sensible questions in a civil manner. They are asking dumb questions and voicing idiotic objections in a not always civil manner. Do you understand or do I have " more 'splaining to do".?
I'll admit that past hearings may have had questions being asked solely on the basis of politics by both sides. But some proposed nominees legitimately deserve serious questioning, ex Robert Bork, who argues against living constitutions . His argument would see the reinstatement of slavery, and reversal of constitutional amendments since the original draft. The man is a kook. Harriet Myers , Bush's cleaning lady reviled on both sides. these people deserve serious questions.
no,not all Dems have been pleasant for republican nominations. And, how could anyone, even a mindless brainwashed liberal, support this cunt?
She values affirmative action over safety. wouldn't you rather have the life of your family members in the hands of the smartest people- not the affirmative action appointees.
Exactly, when you decide a case you create precedent, judiciaries at least in a legal system based on precedent do in fact make law.
So if the US legal system is based on precedent and not legal principle as the French Legal system is, then all this talk of judges not making law is ignorant poppycock.
Also life experience does matter, in many instances the facts of trial cases as presented to the court makes an up or down decision difficult. Insight into the situation via life experience helps
This conflict of legal "roles" does not stop with members of the judiciary getting to legislate. Presidents are authorized to write "executive orders," which essentially allow the executive branch (the law enforcement body) to create laws (legislate), too. In addition, legislators (the law-making body) have direct authority over Capitol police; as such, they can command the police to arrest people as they see fit (for civil disobedience or contempt of Congress, as can be seen in recent vids).
All this talk of judges not making may in part stem from instances of real judicial excess, but it may also stem from the disappointment some groups may have with legitimate decisions made in some cases. I'm not American or a lawyer so I don't know for certain. It just seems to me, the anti legal activism argument is just sour grapes.
It's as crazy as arguments against a living constitution
Yes legal activism is a cowering down to public opinion and should never be a consideration, unless your a politician in 18th century France facing the guillotine, then you might want to say "Chaaaaa.... you know what....

Sonia Sotomayor has charges that are laughable at best levelled at her. These charges stem from the GOP's need to satisfy their base ( or R. Limbaugh). Anyhoo the charges are ridiculous, the GOP needs to come up with better ideas and stop wasting their own time on nonsensical talk radio driven crusades
