  • Hmm...the IRS agents get to use fake names to disassociate themselves from their job and it's ok. However, if I use a fake name to disassociate my real self from my job then the IRS gets all in a huff.

  • Great video until you made your lame, super-politically-correct comparison between the IRS and the National Socialists. At least you saved that comment for the end. BTW, when you said "Kerry Martin, you don't have to do this" you reminded me of the movie "No Country for Old Men" where every victim told the killer right before they were murdered "you don't have to do this." They know that, but they are parasites who can't be corrected. That's why guns were invented.

Ironically, the fact that I have little left for them to steal makes their intimidation less effective. That may soon be true of a lot of people: when the economy is falling apart, and people are losing their jobs and their homes, what do they have to lose by not bowing to the IRS?

  • Independent subcontractors are not eligible for tax withholdings from the employer. This guy is in the right.

  • The "on' and "to" nonsense is lame. The statute clearly means that, if you send stuff to someone, tell the someone what to do with it, pay the someone to do it, and get stuff back from the someone, the someone is an employee for employment tax purposes, regardless of the usual common law rules for the employer-employer relationship. You can rant all you want, but it doesn't change the law.

  • @LarkenRose The statute doesn't refer to work being done TO materials, it says ON. Your employees worked on the tapes by transcribing the words on the tape to paper. This is similar to a case in which a worker who gathered data and collated it using a software template (which the court held was a "material") furnished by the employer was held to fall under 3121(d)(3)(C). Incidentally, did you issue 1099's to your typists?

Regarding self-employment tax, I have no way of knowing whether the typists ever paid any or whether any was ever refunded, and I'm certainly not going to take your word that it wasn't. Btw, you never said whether you issued 1099's to your typists, as the law requires if they were indeed independent contractors (I assume you paid one or more of them $600 in a year).

  • The pseudonyms the agents use crack me up. I've been on the phone with 15 irs agents (all of them recorded) and I seriously doubt any of them are using their real name. "The due process" they claim to abide by is a colossal load of shit. They deemed my evidentiary questions a "frivolous" argument regardless of the fact I wasn't even making one. I was only asking if they had personal knowledge or factual evidence that I was a taxpayer with liable taxable income.

  • I think one of the awesome things about you and your attitude, Larken, is your effort to still remain positive, balanced and truthful under the weight of what would crush most of us, plus your intermittent ability to offer the evildoer an alternative. I go a couple rounds with the city, state or fed (IRS) pretty much every year. Just what I've gone through is psychologically very difficult, and what I've been through is not nearly as hard-ball as what you've been through.

  • 5 years ago, I used FOIA requests to obtain and decode my Individual Master File with the IRS. They had me listed as a self employed resident of the U.S. Virgin Islands, which exposes the Art 861 fraud. I wrote them a 78 page rebuttal letter with evidence and exhibits to correct my Master File. To this day, I have NEVER heard back from them at all! I only received the 'return receipt' back in the mail. The IRS is the biggest and most well funded terrorist group in the entire world!!!!!!!!!!

  • By the way, check with your county Sheriff. They get 10% of the amount owed, if the arrest a citizen with a tax debt...

    I followed you're 861 taxable income writings closely. I was able to get two administrative hearings with the IRS in my fight and both times they refused to show the law they were using. Needless to say they destroyed my life as it was. Now I know the rule of law is dead in this country.
