  • This is silly. It's disingenuous to say that he was 'legally' operating a pot shop when federal law bans such practices.

    I'm a supporter of legalizing/taxing the crap out of hippies who smoke weed, but it's got to be legalized country-wide. You can't just make it legal in a state any more than you can make rape legal in a state.

    I can't see how the drug laws are unconstitutional, but if you're right, then this guy won't be going to jail anyway. He just needs to get the law thrown out by the court.

    Again, I have no idea what makes you believe that the federal drug laws are unconstitutional. You may be right. But the answer is not to break the law, the answer is to get it removed for its unconstitutionality.

And because it was introduced by a democrat. A majority of the Repbulicans will vote NAY on them.

  • The prosecution would simply appeal the case and the next higher-up Judge would have to take up the case.

  • The only way we are going to stop the persecution of Marijuana users, under the Obama Administration, is to allow ALL Americans to consume and cultivate without ANY taxation, regulation or other interference. All "tax and regulate" models will not destroy the cartels or stop the harassment of law abiding pot smokers. Treat Marijuana like "Beer" and not like "hard alcohol."   • When I tell people I believe in "taxing and regulating" I mean that it should be treated like alcohol. You can go out to any store and purchase as much alcohol as you would like. All alcohol purchased has a state or local tax on it, just like tobacco does. I think such a system is sufficient, as the amount of people distilling their own liquor for illegal distribution is negligible.

  • The better model is the MERP Model which is more of a "beer" Vs. "hard liquor" model. I want people to able to grow Marijuana just as they can now brew beer: NO TAX, NO REGULATION.

  • This isnt a case about POT... this is a case about State rights. The Judge is correct that he cant avoid this, but this needs to be appealed to the Supreme Court to find out if this law is Constitutional.

    My thoughts are this type of thing should be left to the State to decide, because the Constitution doesnt give the Fed jurisdiction on POT or any drug for that matter. Actually, I pray SCOTUS finds that the ATF and DEA are both unconstitutional in nature.

    Not just immunity for telcoms but also for torturers and betrayers of the Geneva Convention.

  • this is a very interesting case. He makes a very strong point that even the president uses the term medical marijuana, when the whole point of the prosicution is about marijuana not being beneficial medically.

  • Remember, to a political class person, spoken words mean absolutely nothing unless they are spoken by your enemy, and only in an election do they actually get used against your enemy. At all other times, if it isn't written in a Bill somewhere (and many times even if it is) the political class can and most likely will ignore it.

  • Obama isn't the puppet of the dems. He is the puppet of the special interests. Most dems support medical marijuana laws. However, corrections, police, dea, and those that profit by keeping marijuana illegal lobby hard to keep it illegal and control most of our politicians. So if you voted for Obama because you believed he would call off the fed on the medical marijuana issue, you have been had. Get use to it this isn't the only Obama promise that will be smashed.

Even if I don't always agree witht he man, he shows no fear in standing up for freedom and the US Constitution... and so far, he's the only politician who has lived up to his oath of office. Every time a LP is on a show, they would waste the session with questions like "LP is pro hooker and pro drugs right?" and completely ignore the fact that LP is PRO CONSTITUTION.
