'Bona Drag' came out in 1990 - some of the songs were co-written with Andy Rourke (such as 'Yes I Am Blind') and Morrissey didn't establish his own 'band' until around 1991, but I think with "Viva Hate" he was deliberately avoiding Smiths musicians.

Rourke brought a lawsuit as well, but he settled early whilst Joyce kept it up and caused a lot of legal hassles for Morrissey. I think that Morrissey and Marr on on pretty good terms and have been for a while. Morrissey has said that if they were to reform it would not be as The Smiths but as "Morrissey and Marr" like "Page and Plant". Perhaps that's a bit of the old Moz wit.
