I dont consider roms that are severly outdated, like snes roms, illegal, if no one cares about them anymore. If its stuff that is still circulating on the market, like hacking wii games, that would be illegal

They're still illegal. It's just that no one will care to sue because of how old it is and all it will garner is bad publicity.

It's just like how fanfiction and fanart is technically illegal, but you'd be a COMPLETE IDIOT to sue your fans for expressing how much they love your work in a non-profit way.
