In any legal case, any and all parties who are aware of a crime being comitted can be labeled as co-conspiriters or complicit on any number of levels in the crime. Its simple. The issue here is that Pelosi said that, at the CIA briefing to Congress, the CIA SPECIFICALLY said that they were NOT waterboarding. We now know that they did. Either Pelosi lied about what they told Congress (political trouble for her), or the CIA lied to Congress (legal trouble for them).

The issue of whether waterboarding constitutes torture is a separate but related issue.
