Maybe neither the Professor nor the cop is wrong here. Maybe standard operating procedures (SOP) are at fault. If I was the cop, I would have shut up, and been civil, explaining why I was there, ask if there was anyone else in the house, ask if hes safe, convince myself hes not in danger, apologize for the inconvenience and leave him with an impression that would last-- that the local police are prompt, courteous, protecting his interest and interested in his welfare. An obvious view of how the officer was acting on his emotions is he understood he couldn't arrest Gates in his own home because he hadn't commited a crime but when he stepped on the porch he then had the right to arrest him on suspicion because he matched the profile the concerned neighbour had given.

Gates said on cnn later that day that he is grateful to the neighbor that called the police. The neighbor did nothing wrong, the police did. Gates identified himself as a Harvard Professor with TWO forms of identification and still the officer arrested him, for what, knowing his rights? Maybe he was talking back, but is that a crimes? Should Gates have been arrested, cuffed, booked, fingerprinted, and have to take a mug shot? Would that have happened if he was white? I don't think so.
