    the irs hounded me for months to file my back years and now they owe me 6,000. actually 8, 500 including this year. morons. and this year all their efile stuff is hosed up so we can't get our refunds unil the end of february and some peeps not even then. something needs to be done about the irs. we should go to a flat 15 percent for everyone and fire most of them. we pay them to treat us like crap.

  • The IRS use of "voluntary" has zero to do with either filing or paying. It refers to you being allowed to voluntarily self assess your tax liability, if any, rather than having the government do it for you and send you a bill. You are required, by law, to both file a return and to pay any due taxes.

  • Look folks I have called the IRS and they cannot cite a specific law that requires people to file (different from paying). I spoke with an H&R Block Associate and still no specific law requiring individuals to file. I spoke with a tax attorney and they tell me that there is no specific law, just a mixture of regulations thrown in the mix and force to imply that there is. But, there is nothing in black and white that says you must file (different from paying).

  • @RetSquid So you think because it says "every individual" it applies to every individual when it is narrowed down to those subject to tax under subtitle A or any person required to file a return of information with respect to income. Look at Title 26 Section 1461 (keyword: "withholding agent".). Now look at the definition of "withholding agent" in Title 26, Section 7701(a)(16). As for "any person required to file a return of information with respect to income", income is not defined in tax code.

    Yes, it means for "EVERY individual" subject to the Code, that means every resident of the United States and every Citizen of the States, who has over the exemption amount of income. "Withholding agents" are those who have employees to withhold income tax from, not hte averqge person out there.

    The word "income" is not defined, but "gross income" and "taxable income" ARE defined. For the word "income" you use the normal, everyday definition.

  • Yes unapportioned taxes are forbidden by the constitution. yes congress may tax, but income taxes are unapportioned and therefore by the constitution illegal. Any law passed to try and make it legal, is itself not legal. But again make your business private and give up trying to make power mad government terrorist obey the law or the constitution.   • Title 26 is not law its code or statue and its not the same thing. Yes incme tax is voluntary, but just try and not pay!! These tax protesters are basically taking the path of "most resistance" the tax people will never accept that what they do is illegal and stop. The best approach is to make your life private and transparent. Create a corporation and it pays taxes, but much lower, and keep your personal money, the tax terrorist are never the wiser as long as they get something.

    3) Section 861 does not apply to Citizens of the States. Cititzens are liable for income tax on income from anywhere in the world.
