the irs hounded me for months to file my back years and now they owe me 6,000. actually 8, 500 including this year. morons. and this year all their efile stuff is hosed up so we can't get our refunds unil the end of february and some peeps not even then. something needs to be done about the irs. we should go to a flat 15 percent for everyone and fire most of them. we pay them to treat us like crap.
The IRS use of "voluntary" has zero to do with either filing or paying. It refers to you being allowed to voluntarily self assess your tax liability, if any, rather than having the government do it for you and send you a bill. You are required, by law, to both file a return and to pay any due taxes.
@thinksmarter This is the same tired argument which has been tossed out every time a tax protestor tried to use it. You want the specific law citation requiring the filing of an income tax return? Internal Revenue Code §§ 6011(a) , 6012(a) , et seq., and 6072(a). See also Treas. Reg. § 1.6011-1(a)
Look folks I have called the IRS and they cannot cite a specific law that requires people to file (different from paying). I spoke with an H&R Block Associate and still no specific law requiring individuals to file. I spoke with a tax attorney and they tell me that there is no specific law, just a mixture of regulations thrown in the mix and force to imply that there is. But, there is nothing in black and white that says you must file (different from paying).
@RetSquid So, I am automatically the ignorant one or liar? Where in Section 6012 says "everyone is required to file"? Instead of calling people names show me where it requires everyone under the sun to file.
@RetSquid So you think because it says "every individual" it applies to every individual when it is narrowed down to those subject to tax under subtitle A or any person required to file a return of information with respect to income. Look at Title 26 Section 1461 (keyword: "withholding agent".). Now look at the definition of "withholding agent" in Title 26, Section 7701(a)(16). As for "any person required to file a return of information with respect to income", income is not defined in tax code.
Yes, it means for "EVERY individual" subject to the Code, that means every resident of the United States and every Citizen of the States, who has over the exemption amount of income. "Withholding agents" are those who have employees to withhold income tax from, not hte averqge person out there.
The word "income" is not defined, but "gross income" and "taxable income" ARE defined. For the word "income" you use the normal, everyday definition.
@RetSquid I can see that you are just here looking for an argument. I was here to clear things up. I will not satisfy your needs, but what you are arguing touches the information at face value. It is interesting that even paid "professionals" don't have as much heart as you do in specifying the law to file. They are not looking for an argument just to argue either.
@RetSquid I'm sorry you have chosen to troll around on the internet all day claiming that your right about everything you argue about. It was probably you who removed my comment as I must have hit a nerve. If I'm both ignorant and a liar you must be an ignoramus sheep.
@RetSquid Nothing is more annoying than someone who thinks and believes wholeheartedly that they are right, especially when they don't have the slightest nuance towards the objective of being a student to a subject they feel they are an expert in. I came to clear things up and you want an argument. No thanks.
I am in no way an 'expert', but I obviously know more about the subject than you. The fact that you don't even try to dispute the facts but go directly for an attack on me supports my claims. I "cleared things up", you want them as confused as possible, that way people may think you know something that you don't.
@RetSquid Oh yes because you say so right? This went from disputing facts to your attacks calling me ignorant and a liar and the butt-sex crap you threw in. So, if anyone is childish you are spot on. I quit disputing facts as that is not what this is about anymore to you. It's become a name-calling pissing match and I don't want to waste your time and certainly not mine. The confusion is not me, the confusion in the code. This video is not about me, it's about a confusing code.
Now you are continuing to try and turn this into an argument about me, why can't you stick to the facts without attacking me? You were ignorant about the law, I showed you the law, now you are not ignorant. If you continue to say that "there is no law", you become a liar. It's VERY simple.
TITLE 26 > Subtitle F > CHAPTER 62 > Subchapter A > § 6151 Time and place for paying tax shown on returns
(a) General rule
Except as otherwise provided in this subchapter, when a return of tax is required under this title or regulations, the person required to make such return shall, without assessment or notice and demand from the Secretary, pay such tax to the internal revenue officer with whom the return is filed, and shall pay such tax...
Yes unapportioned taxes are forbidden by the constitution. yes congress may tax, but income taxes are unapportioned and therefore by the constitution illegal. Any law passed to try and make it legal, is itself not legal. But again make your business private and give up trying to make power mad government terrorist obey the law or the constitution. Bide your time, soon these crooked bastards will fall and be running for their lives. That is what we really need to worry about, not taxes.
Title 26 is not law its code or statue and its not the same thing. Yes incme tax is voluntary, but just try and not pay!! These tax protesters are basically taking the path of "most resistance" the tax people will never accept that what they do is illegal and stop. The best approach is to make your life private and transparent. Create a corporation and it pays taxes, but much lower, and keep your personal money, the tax terrorist are never the wiser as long as they get something.
@WarriorVisions What in the world are you talking about? He is absolutely correct. There is no law the requires you to "FILE". That is different from "PAYING".
US Code Title 26 has the laws requiring income tax on taxable income and the filing of an income tax return. It's pretty clear cut but the tax protestors keep trying. And failing.
@WarriorVisions You can only legally be taxed on profits and gains.
If you go work 8 hours for Wal-Mart and they pay you $10.00 per hour, that means you earned $80 right?
Did you profit $80?
Did you gain $80?
The answer to both questions is NO. It was a equal trade that both parties agree to. You did not profit anything because you TRADED 8 hours of your time and energy for the $80. You will never get that 8 hours of your life back. How did you gain or profit anything?
@RetSquid The vid is from a Congressman and it is correct. There is no law forcing you to "FILE", it doesn't say anything about 861, which is arguing that there is no law requiring you to "PAY". See the difference?

Here is ’the law’: Title 26
Section 1, imposes the tax
Section 61 defines Gross income
Section 63 defines Taxable income.
Section 6012 requires you to file a tax return if you have income of more than the exemption amount, and
Section 6151 requires you to pay the tax at the time and place fixed for the filing of your return.
