  • Officers have to have reasonable suspicion a crime has been committed before asking for ID. If called to a scene or traffic stop, he does have the right to request ID to insure officer safety, determining if he is dealing with a dangerous person(s). He has the right to detain and investigate for a reasonable amount of time. This is according to Hiibel v. Sixth Judicial District Court - that was upheld by the US Supreme Court. This ruling further solidified the “Terry pat” - “Terry v. Ohio”.

  • @sj702: Well said. The only addition I'd like to add is that the state must have legislation enabling the authority to require ID, and ID can be given verbally.

  • You don't have to show your ID to cops but you have to identify yourself. I believe there was some Supreme court decision about that. Here in Cali they ask for your name and DOB instead of ID.

  • @zebra334 That was an EXEMPLARY display of authority on behalf of the officer. Also, the camera man did a great job of respectfully communicating his knowledge of law, and protecting the truth. Nobody lied though, and I didnt see the officer as an intimidating type, even though he's trained to be a 'tough guy', and probably IS. Compared to every officer that I ran into as a youth, he looks like a fuckin' SAINT! lol

  • He did ask for ID...However, it was great to see that he didn't push hard and he knew the law and backed down. So many of these cops simply don't care and do whatever they want.

  • Where I live you have to show your ID if police ask you. They can ask for any reason and if you are not caring a ID they can take you to the station to confirm your identity if they feel its necessary.

    Personally, I dont really have a issue with that. It removes more problems than it adds because the police officers know who they are dealing with and it makes them less edgy as well. Then again, police injustice here is very low.

  • @spiderTV1 Texas penal code 38.02. Only after you are legally arrested and it is requested do you have to give your name, address, and birth date. If you are driving you must give your DL. If you are not driving, the supreme court has ruled you do not have to carry a ID at all, so you are not required to have to show one ever.

    Never give false information, only refuse to give your real information.

    I haven't seen the Indiana statutes but I'm willing to bet that all I have to do is state my name and perhaps a few other bits of identifying info.

    Of course officers have to be investigating criminal activity and suspect that I am involved before they can demand that I answer.

  • @gstonegraphix This is true, but ONLY if there is reasonable suspicion of criminal activity. No suspicion = no need to give/show/provide any ID.

    If they detain you anyway without suspicion, they are breaking the law and the detainee can, at their choosing, start a lawsuit.

  • @SpiderTV1 any chance you can talk with a citizen - police oversight group, The National Lawyers Guild, ACLU, or any civil rights attorney might be able to point you in the right direction. If there is any "Copwatch" organizations around, they might also be able to clarify or lead you to one that could. {just a few ideas]

  • @zebra334 It's a good idea to carry it though (like he said). Although you should not surrender it to police for no lawful reason, if you were, lets say, injured, doctors could look at it find find out who you are and what medicines you are on, etc.

I dont like how "Law Officers" using the color of law, then intimidate people to give up their rights ...(in my case having to show ID for NO reason). Sure he says "Im just asking" --> The fact that cops "try" to and hope you dont know your rights, as he said "Most people donet know..." So Why does he abuse the fact "most dont know"? And or most will comply because he is in uniform.

  • My hats off to the policeman and the protesters! The policeman and the man video taping were both very reasonable and civil in their exchange. Police are taught to sniff around for crime and so it is natural for them to ask for I.D. at any opportunity. The man video taping respectfully declined and the cop did not press the issue. Score a big point for liberty and civility.

  • Excellent job staying polite and respectful! That "What do you have to hide?" argument often works on naive citizens, but the bottom line is that we are innocent until proven guilty. If the officer doesn't have reasonable suspicion of crime, you retain your right to privacy.

  • The cameraman handled himself very well. A lot of the times when people refuse to give a police officer there I.D they say it with a since of humor to it. As if they are getting a psychological boner in not doing what the cops wants of them. Which kind of annoys me. Cuz they come off more of an ass, rather then a citizen protecting there rights But this guy said it in a calm, cool, and collect tone in his voice. The same way he would say it to a normal man/women on the street and not just a Cop

I know bybee is or was in Seattle and protested there by Susan and her band of wonderful ladies. So the fed was saying refuse to give me what I want or you become a suspect. Holder refuses to arrest war criminals but Homeland cops spend their time screwing with people protesting a criminal judge.
