Scalia interprets the Constitution as it is; as it was written when it was ratified. Scalia doesn't vote politically, he has voted against his own political views to protect the sanctity of the Constitution. How is his interpretation fascist?

Scalia belives many cases have been ruled in error, including probably the use of the 14th amendment to apply the US constitution to all states (doctrine of incorporation). However, as a practical matter he accepts precedent when it is not excessively flawed. Thus, by precedent of the doctrine of incorporation, the 2nd amendment applies to the states, just like the 1st amendment.
