    If the members of congress and past presidents were tried on the same standards as Bernie Madoff for creating a Ponzi scheme ie. SS as pointed out in 1960 by Barry Goldwater when he tried to reform it in tha senate they would all be in prison.   • Social Security was ruled as constitutional in 1937, the same year people started paying into the system. It couldn't have been ruled constitutional or unconstitutional prior to that era because it didn't exist. Of course, Social Security wasn't the first time Congress or the presidency invoked the General Welfare Clause.

    Also, I'm not arguing with Hamilton - Hamilton agrees with me.

    The fact that the Supreme Court struck down some early New Deal programs doesn't change the fact they also upheld the Hamiltonian view of the General Welfare provisions in the US Constitution in US vs. Butler. And again, General Welfare has been cited by various Congresses and presidents long before FDR.

Those which are to remain in the State governments are numerous and indefinite." My bad... going from memory! Does it make a difference to you that Madison wrote this vs Hamilton, does it make a difference that Hamilton was never president, does any of this history matter to anyone? Yes, it's been done before, but that doesn't mean that it is proper!

  • Who said history doesn't matter? I'm the one correcting a couple of inaccurate statements you made, which was that Hamilton opposed a broader interpretation of the General Welfare provisions, and that he wrote Federalist 47.

    Strangely enough, one of the strongest opponents of Hamilton and a broader interpretation of the General Welfare provision, namely Thomas Jefferson, made a general welfare argument in acquiring the Louisiana Purchase.

  • The didn't have foreknowledge about these events, thus they left specific avenues for change (e.g. amendment process and leaving most of the issues to the states).  Your belief that the constitution is a living document does not make it such... in fact, if it were living then why propose an amendment process, that would be utter foolishness. I didn't mention the federal highway system... and no it is not the same concept (don't assume that I am stupid and that I will be inconsistent)!

Throwing away the laws, founding principles, and documents that our country is based upon, or providing health care to 46 million people who can already obtain free care from any hospital? The federal law applies to hospitals that participate in Medicare -- and that includes most hospitals in the United States. This does not include preventative health care... thus the argument: prevent is cheaper than emerg care... welcome to the pragmatic side of the argument (arrogance intended).

Be thankful that someone cares both about your freedom at home (i.e. the maintenance and care of the constitution) and is willing to defend you abroad (i.e. against those who seek to perpetrate large scale terrorist attacks against innocent Americans).

During the Bush years the constitution was certainly stretched, but it was never leaped across as is proposed in HC reform. If you want a public option then amend the constitution.
