We seem to be getting our standards of proof and legal cliches mixed up here.

The impeachment trial is just a legislative firing. No "guilt" need be proven, thus none need be disproven.

The standard is MUCH lower as Blago is not being deprived of life or liberty. Only property (in the legal sense). Thus, the Fifth Amendment - NOT the Sixth applies.

"Innocence before guilt" simply is not applicable here.

And yes - they can do this to us - if we happen to be a Governor being impeached.

He is allowed to make a defense. However, the Senate passed rules to protect the criminal case by request of the U.S. Attorney. The alleged sale is not the only thing he is being impreached for. He has done a good deal of other things. The criminal charges were the straws the broke the camel's back. Long story short, he is a self-serving cry baby.
