NY State has a stop-and-identify law, which requires individuals to at least verbally give their names to law enforcement when asked. Since they were on foot, they were not required to carry ID, and could have just said "I don't have any on me," but were legally obligated to give a name. IMO there's a problem when law enforcement isn't in police uniform but rather in religious garb no different from what a waiter might wear -- I'd want to see HIS id before giving him mine.

As per People v. Offen, in NY you don't have to identify yourself to a police officer at their request. They can demand ID and a name under the stop-and-identify practice, but you don't have to give it. I don't know the law regarding reasonable suspicion, but this incident definitely didn't qualify for reasonable suspicion under any definition. Good luck with the complaint! I hope all those in question get punished appropriately.

When being questioned, failure to identify yourself and evading questioning can get you detained for up to 48hours in the US without being charged. Is it right? no. But it is a safe bet. If they would have just shown their IDs and said they were touring the town they should have no problems. but they didnt. Cooperation greatly improves your chances of leaving

You're walking around with a group of people taking random pictures of local structures. How are they to know you're not some terrorist planning to blow up buildings in the community? They have every right to ask you for ID. Just try doing the same thing on the George Washington bridge and see how far you get. If you would have just produced your license, none of this would have been an issue. I don't see anything wrong with anything the officers did.

NOT a hunch, NOT suspicious activity, these officers violated the law. The law is the law. NO citizen in this country is required to have id. IF a person is legally detained and they were NOT. then they are only required to state there name. READ THE CONSTITUTION. The 4th amendment.

The officers in this case did not comply with New York or federal law. I have every right to take photos of any public building unless that building has been designated as secret by the federal government and in that case they must post warning. IF I am detained on the GW bridge for taking photos, they would be breaking the law.

As it is, they engaged in behavior that could have been reasonably interpreted by a bystander as suspicious and when subjected to a reasonable request from a law enforcement official, they got a big damn chip on their shoulders and refused to reasonably cooperate. This isn't about not carrying ID, it's about not reasonably cooperating.

They were arrested because it was evident that they were not citizens of that community. In a way, it is similar to (though obviously not the same as) racial profiling. Racial profiling is strongly frowned upon in the US, yet it still happens. When it does happen, protests occur.

B) It was not assault. We have no proof that Moses actually took a tight grab around JZwinck's arm, he could have held his hand on his shoulder if anything, which still is not defined as assault (go ask your lawyer).
C) The police was allowed to ask for your ID as you had been reported by a citizen of the United States. If you are first reported, you are a suspect.

The denial of identification added time to the incident, yes. He could have taken the easy way out by handing it over but he believes, as I do, that citizens need to stand up for their rights to remind everybody just what those rights are.

Why bother being difficult when you could have solved the issue in a matter of seconds. I'm not saying this is the solution in all cases but for this one it would have saved a lot of time and unnecessary bother.

As per People v. Offen, in NY you don't have to identify yourself to a police officer at their request. They can demand ID and a name under the stop-and-identify practice, but you don't have to give it. I don't know the law regarding reasonable suspicion, but this incident definitely didn't qualify for reasonable suspicion under any definition. Good luck with the complaint! I hope all those in question get punished appropriately.

I think they had a better case against the constable. The state troopers are a third party with no inclination to favor either group. If they would have just complied, they might have had a smoother ride. I don't understand why they arbitrarily decide that the state troopers are the enemy. Clearly, the constable is at fault here, and the state troopers are not authorized to deal with complaints regarding other police departments.

@Robstailey To be fair, the officer was going off what the beard told them and has to take that into account when dealing with suspects. When being questioned, failure to identify yourself and evading questioning can get you detained for up to 48hours in the US without being charged. Is it right? no. But it is a safe bet. If they would have just shown their IDs and said they were touring the town they should have no problems. but they didnt. Cooperation greatly improves your chances of leaving

This is their reason for suspicion and the fact is, the beard placed the call, not the kids. Therefore, the kids are in question, not the police, not the beards. The police did not see the same video you did, so as far as they know the kids are disturbing the area and are now refusing ID.
