Randy was learning classical guitar at the time, so he didn't steal it. He was inspired.

and it wasnt the exact structure of playing,
it , of course, is in the same chord structure, but the strum patter is different.
in "Diary of a Madman" the strumming is more similar to that of an arpeggiated chord
