Three of these cops are on trial right now in NYC, and the trial's been going on for over 3 weeks. The biggest issue so far is figuring out if the cops ID'ed themselves before opening fire. The LT who was in charge of the task force said in court that he didn't hear anybody ID themselves before the shooting started. The trial is being heard by a judge instead of a juty. The two survivors from the car begin testimony tomorrow.

If you read the UC's statement, you'll see that he didn't open fire because the car drove at him, he says he fired because he assumed the passenger was going for a weapon. The question that will get answered by a jury is, is it in anyway a crime, or an excessive use of force to shoot at a moving car because of an assumption that gets proven to be false? Like I said before, this case emphasizes the fact that plainclothed officers shouldn't approach people on the street. To much can go wrong.

The investigation has already acknowledged that there was no gunman at the scene or in the car. This is another case of mistaken identity, and it will probably cause a change in policy for the NYPD. Plainclothed officers shouldn't be approaching people on the street, to much can go wrong.
Were is the gunman who ran away? Was a drug test done on the suspects? What did the driver used the car as a weapon. If the City of New York knew if this place was a trouble spot, why didn't the City of New York shut it down. There are laws on the books to punish just such crimes, and they do happen somewhat frequently. Recently, there have been quite a few home invasion cases using this tactic. I don't know about all these charges being dropped, some of them don't even require proof of criminal intent. It's a lot easier to convict on lesser charges like that. This shooting is also unique because there are two survivors from inside the car itself that will be able to testify, that's usually not the case with these kinds of shootings.

It has been my experience that cooperating with the police is the best way to avoid getting in trouble with(or shot by)the police. Stop when they say stop. Put your hands on the steering wheel and wait for further instructions. Aiming a weapon, (gun/car/whatever) at them is just going to turn out bad -- for you. Regardless of your race.
The car was NOT used as a weapon. According to most other reports on this incident the driver panicked after the first approaching officer established contact by pointing his gun in the driver's face.
Before cooperating with the police, you have to first know they are the police. Any nut job running up to your car with a gun drawn, who doesn't ID himself as an officer, and points his weapon at you is asking for a fight. You would be trying to do everything in your power to get away from, or kill the suspected carjacker/robber. That includes running him down if possible. The cars occupants had the right to self preservation too.
As I understand it, the police did ID themselves. It would also stand to reason that they would do so, as people are less likely to shoot police, so it is in police's best interests.
According to the two survivors, nobody said a thing before the shooting began. There's obviously a difference between something being said and heard. The drivers reaction seems appropriate if he thought he was being carjacked, it makes sense he'd try to get away. It sounds like this whole event occured because of assumptions made by both parties, neither of which was correct, and that any charges will be based on possible procedural violations on the part of police.
I'm finding it hard to believe the civilians' story. There were seven officers involved. When has a car jacking ever involved seven perpetrators? And what is the likelihood of all seven neglecting to state they were police when it would be in their interest to do so? You are correct that charges will be based on precedure. When the other 6 police officers arrived on scene has never been really been answered. I've read they came out of their vehicle after shooting began. It's an important point. What gets me is why didn't the two UC's approach the suspects before they reached their car? After all, that's where UC's believed the weapon was located. Plus you wouldn't want suspects to become mobil.
The timing of the 2 UCs' approach is weird, you are right there. Could it be because there were more than 2 suspects and they wanted all of them in confined area (like a car)? I don't know.

Three of these cops are on trial right now in NYC, and the trial's been going on for over 3 weeks. The biggest issue so far is figuring out if the cops ID'ed themselves before opening fire. The LT who was in charge of the task force said in court that he didn't hear anybody ID themselves before the shooting started. The trial is being heard by a judge instead of a juty. The two survivors from the car begin testimony tomorrow.

And, police are authorized to shoot at a vehicle if it is posing to threat to them, a fellow member of the authorities, or an innocent person. If you read the UC's statement, you'll see that he didn't open fire because the car drove at him, he says he fired because he assumed the passenger was going for a weapon. The question that will get answered by a jury is, is it in anyway a crime, or an excessive use of force to shoot at a moving car because of an assumption that gets proven to be false? Like I said before, this case emphasizes the fact that plainclothed officers shouldn't approach people on the street. To much can go wrong.

The investigation has already acknowledged that there was no gunman at the scene or in the car. This is another case of mistaken identity, and it will probably cause a change in policy for the NYPD. Plainclothed officers shouldn't be approaching people on the street, to much can go wrong.

Did you listen to the audio? The cops were conducting "surveillance" on the business & "tracking" the men. There was no warrant, there was no probable cause, there was no crime, there was no victim. The only thing the cops MIGHT have had was a suspicion of carrying a weapon - not good enough reason to attempt to kill 4 men. "No previous record" - do you actually trust the cops to police themselves?

There are laws on the books to punish just such crimes, and they do happen somewhat frequently. Recently, there have been quite a few home invasion cases using this tactic. If the cops are acting and dressing like thugs, they deserve the same treatment, tin badge or not. Remember, Sean Bell & friends committed no crime and were peaceable...until assaulted.

I don't know about all these charges being dropped, some of them don't even require proof of criminal intent. It's a lot easier to convict on lesser charges like that. This shooting is also unique because there are two survivors from inside the car itself that will be able to testify, that's usually not the case with these kinds of shootings.

Unfortunatley those who were shot voiced aloud that there was a gun present. At that point an officer is on alert and any wrong movement is justification to shoot. As an officer you can't wait to confirm the prescence of a weapon otherwise you'd end up getting shot. You have to realize it's not difficult to comply with an officer when you are told to stop. Officers are put in a bad situation when a car is charging towards them. What would you do? Think hard about it.

There aren't going to be any winners in this case, the families of the dead and wounded already know the price they've paid. The police will almost surly go on trial for the procedure violation, and could easily
go to prison for it. The NY Post, perhaps the most conservative paper in the country had a senior city detective say this shooting was a major screw up. It looks like he's going to be proven correct.

The New York Police Department and other law enforcement agentcies deal with dangerous and sensitive issues every day(many life and death). And its important for everyone to know that mistakes like these will happen. It's unforturnet, however if you have to make a split second decission on if someone lives or dies these things will happen. Im a black man who has been a police officer for 30 years and I can tell you that no one is a in a situtation like this.

It has been my experience that cooperating with the police is the best way to avoid getting in trouble with(or shot by)the police. Stop when they say stop. Put your hands on the steering wheel and wait for further instructions. Aiming a weapon, (gun/car/whatever) at them is just going to turn out bad -- for you. Regardless of your race.

Before cooperating with the police, you have to first know they are the police. Any nut job running up to your car with a gun drawn, who doesn't ID himself as an officer, and points his weapon at you is asking for a fight. You would be trying to do everything in your power to get away from, or kill the suspected carjacker/robber. That includes running him down if possible. The cars occupants had the right to self preservation too.

According to the two survivors, nobody said a thing before the shooting began. There's obviously a difference between something being said and heard. The drivers reaction seems appropriate if he thought he was being carjacked, it makes sense he'd try to get away. It sounds like this whole event occured because of assumptions made by both parties, neither of which was correct, and that any charges will be based on possible procedural violations on the part of police.

I'm finding it hard to believe the civilians' story. There were seven officers involved. When has a car jacking ever involved seven perpetrators? And what is the likelihood of all seven neglecting to state they were police when it would be in their interest to do so? You are correct that charges will be based on precedure. In the mean time, we can expect a fair amount of baseless accusations I suppose.

When the other 6 police officers arrived on scene has never been really been answered. I've read they came out of their vehicle after shooting began. It's an important point. What gets me is why didn't the two UC's approach the suspects before they reached their car? After all, that's where UC's believed the weapon was located. Plus you wouldn't want suspects to become mobil.

You may be right, I don't know either, it just seemed rather risky to me to allow them to reach their car. Indeed, that decision has led to terrible results. I'm sure there's a lot more information that has yet to come to light. It will be a continued waiting game until the Grand Jury publishes it's findings.

You listed a few events that took place during the week. A few bad events out of countless thousands of good events that occured this week by police officers. For every one bad incident, there's thousands more where the bad guy is arrested, or someone is saved by the police. The media doesn't report any of that, because it's not news to them. I believe more suitable food for thought for you would be: how much awareness do you have of the realm of police brutality and abuse of power? The primal urge to fight fire with fire or the reasoning that it is "better to shoot and not need to than need to and not shoot." These occurrences are very very real my friend and they deserve just as much attention if not more than any sensationalized civil unrest in the middle east or other third world location.
