I have heard several hardcore prohibitionists explain that legalizing marijuana (or cocaine and opiates) is NOT within the power of Congress. They first claim that our "treaty obligations" supersede federal or state law. Of course, an act of Congress DOES supersede an existing treaty. When this point is made, the prohibitionists fall back on "international obligations" that all countries have whether they want them or not, like those against genocide and slavery.
