  • If you were speeding, or driving without a seatbelt, or had a brake light out, or didn't use a turn signal, and a cop pulled out behind you as you were pulling onto your road, you can't assume your driveway becomes a safe zone. A cop will do exactly what he did to you here if you assume your house is like the garage on Grand Theft Auto.

  • It is one thing if you are in your driveway (heading towards the public road) and get a ticket in your driveway for not wearing a seat belt and another thing altogether if you pull into your driveway from a public road with the police officer flashing his lights behind you (cause he noticed you were not wearing a seat belt).

  • It's a traffic violation. They can serve it to you at your door, if they don't stop you on the roadway. As for the transportation code, it was accurate for the citation. In short, he was acting in due accordance of the law. Pretty sure you can't file charges against him for anything.

The duress comes from the system lying to me, coercing me and telling me I need a drivers license when all I ever wanted to do was exercise my right to travel in my automobile. Also VC 27315 d1 specifically mentions it is applicable to transporting employees. I was not so how can it be applicable to me?

You drove it those two houses down to your house on a public street, the officer saw you driving in a public area without a seatbelt, you got a seatbelt violation...whats complicated? You think because it was a short distance that its tolerable, but it isnt. The fact is over ninty percent of accidents happen within three blocks of the house. He wrote you the ticket to teach you a lesson and protect you from yourself.

  • heres a idea just wear your seatbelt whenever your driving no matter the on the street in my own driveway i move my car without a seatbeat but only because id have to be a retard to hit anything hard enough to hurt the car or myself. most car accidents happen within a few miles of home i've known a few people who were killed in wrecks only 1 mile from home because they werent wearing their seatbelts. people who dont wear their seatbelts are ruining cars and driving for everybody

Also, crossing out "under duress" is not altering a public document. You are ONLY allowed to sign your name on a citation, you are not allowed to editorialize on said document. The cop was suspended without pay> he witnessed someone intoxicated & did nothing to prevent him from getting in his car and driving. the moment he recognized it, he was responsible for that driver and others that might have affected.     "Date of Offence" it had a date, one or two weeks later.
