I have documents of them openly admitting to disparate treatement, ignoring other employees who commited the same acts. They all have jobs, but the only black employee lost his. I called OPM today about my retirement, since I was going to be entitled to it in May of next year due to being 47 yrs old with 25 years of service. However, they mentioned now I must wait until I'm 56 years old, WHAT?. What injustice. I had just maxed out on my salaries and for 23 years straight I passed all my evaluations. In fact when they terminated me, I was at 100% 98% 97.5%. My manager told me "Do you know how I got use to working next to black people? When I was a manager at McDonalds"

CRSA, does not allow federal employees such as myself to sue for wrongful termination, regardless of how much documentary evidence or proof you have. Even on my motion to dismiss there are so many lies on it. For example: It stated CRSA allowed me two remedies to appeal my adverse action - 1. grievance or 2 EDR (Chief Judge) and I chose grievance. When in fact, the adverse action specifically stated I must appeal via grievance only and it did not offer me a option to appeal to Chief Judge.

I did not want to file a lawsuit but I was left with my back against the wall. The U.S. Attorneys office here has filed for a "Motion to Dismiss" my case for "lack of jurisdiction. I was ready to defend my rights as an American citizen. Come to find out that judiciary employees from the federal courts are exempt from suing and Title VII doesn't apply, What? Basically, my manager is getting away scott clean for discriminating against me and I have no recourse.

On April 2010 (less than two years away from retirement), my manager called me into his office and said I am being terminated and offered me a severance package, which I declined to take. He then immediately fired me. I appealed with documentary evidence, but my terminated stood. I filed for unemployment, which they tried to block. I had to appeal it. They didn't show up and I had to fight and prove my case and I won my unemployment. March 2011, I filed lawsuit for wrongful termination in D.C.

March 2010, I discovered a feature on the courts operating system which showed that 60 similar situated employees outside my protected class were making noticing errors, however, my manager was only interesting in disciplining me for noticing errors. I show my findings to staff and management so we as a court could get a better handle on our job due to poor training. If every employee is making the same error, wouldn't you think its training and not the employee?
