  • For a person to qualify for citizenship or green card via marriage does that immigrant have to already be in the US with a visa OR if an illegal alien already in the US marry their american citizen boyfriend will that illegal alien be able to gain any type of residence card or green card etc

  • I am american and live with my wife (japanese) in Japan. Suddenly I just got offered a really good job in the US, but it starts in a month. Now i have to leave Japan without her. I told her to come to the US and we could just get married here and file all the paper work here, but doing research online it seems risky and we heard stories of people being denied entry and the chance of making the whole process 100x more complicated then it already is. What is the fastest yet safest way?

  • thanks for this propper video. i can absolutely confirm every word in it. im a foreigner tried the US green card lottery many times but never had luck. i studied the US immigration law for months!! had a girlfriend in the us but when i told her about the support thing she must fill she got cold feet. the US immigration law is very harsh and strict but on the other hand it is a good thing too.

I'm in NY by the way. Also we want a destination wedding. With that said, we though about doing something really small here in the states just to get the paperwork straight so we can both travel for an upgraded wedding.

  • Scenario: Been here on since 2003 on a F1 visa, graduated in Dec. 2009 and volunteer for a small start up company within the 3 months period to stay "in status". Now about 5 months from hitting that 1 year OPT limit. Good thing, I'm engaged. Bad thing; she accepted a position to work under a Doctor in Alabama while planning on getting her MBA down there as well....

  • Your first rule was very interesting. I was under the understanding that it would be in our (the couple's) interest for the foreign party to enter legally. Are you saying that we should use another visa besides the K series ones? My gf is a Canadian and I saw on a website that they did not need to provide proof of entry at all. Another question on criminal backgrounds. I have a felony drug charge, but my Canadian gf has a clean record. Will my record affect her green card eligibility?

I am a Canadian always lived in Canada cause I didnt wanna be an Illegal Immigrant and have been married to a U.S Citizen for 5 years now and have been off and on because paper work was not done properly ect.. cause lots of problems for us as a couple. We love each other VERY MUCH! and this time am for sure hiring an Attorney.. it is rediculous how hard the paper work is. Thank you again!!! Well do it right this time for us and our lil boy.

  • @velazquezzz03 I believe that money cannot be recovered but since your old forms were filled incorrectly, they shouldnt charge you when you file again. Also, im guessing that the marriage went into an illegal status after the interview? You probably didnt have enough proofs or paperwork that shows the marriage is indeed real. You should contact a lawyer because once the USCIS claims your marriage is illegal, its very hard to change their mind.

  • @JeetSingh22 No. If you have other proofs that the marriage is indeed real. Proofs such as bank accounts, living same address, taxes, healthcare, etc. Ceremony isnt a big deal. You usually spend big bucks in ceremonies, therefore some people just have a small dinner with close friends and thats it. Tell the interviewer that you wanted to save money so big ceremony wasnt needed

  • My question is this, how can my fiance come over here and we get married and set up a life together , when he doesn't have a social security number and he came over here on a visa waiver?Will he not get into trouble for that ? Will they not arrest him?

  • @TheArcadia54 First of all, social security are only given to permanent residents. So logically everyone should know foreigners don't have SS#. Unless he has commit serious felonies elsewhere, he shouldnt be arrested and he is being protected by you, an american citizen.

How or what can we do to get her green card, so that she can work here and not have fear of deportation? Thank you for your time.

  • @JOSIAS7820 File for I-485 to adjust her status from illegal to legal resident. Please make sure you have all the paperwork ready before the interview comes. Things such as bank accounts, living under same addresses, taxes, health care, etc. Since she's been here for so long, the interviewer WILL suspect the marriage might be fraudulent and check her background for any serious felonies, therefore having all the paperwork ready is extremely crucial. Good luck in the interview!

  • If I go to the america on vacation and stay there forever, would i still be considered as an illegal immigrant?? if so how much time needs to pass until i become illegal? one last thing... if my employer sponsors me and after i get the green card i change my job, will i be illegal again??

  • @carljuve Yes, if you overstay your tourist visa (often just a few months, something like 2 or 3 months max) you will be illegal, will not be able to apply for IDs or work. If your employer sponsors you, and you do get a green card (often takes at least 1 year), you can change your job, it wont matter since you are already a legal citizen with a green card. The key is not change job while still filing for green card, otherwise it will be denied

  • @cris103009 File for adjustment of status, form I-485. With that, you first receive a employment authorization card and later green card. But be aware, after you receive your work card, you will also receive an interview notice. YOU MUST PASS THIS INTERVIEW THE 1ST TIME OR IT WILL BE A BURDEN LATER ON TO GAIN CITIZENSHIP. Bring all the paperwork like marriage license, taxes, bank accounts and other documents that can prove the marriage is very real. Good luck !

  • marry him thats how my lady helped me make sure u take alot of pics to gether with dates on the bottom and get a lawyer the it should take him 4 months to hear from the i.n.s that he has to apper for a meeting, well if hes mexican like me it will take a year or more but it can get done, i did it.

  • @thekong153 The interview notices now arrive even faster, like 3-4 months even if you are mexican or not! USCIS is speeding up all the applications. Before you had to wait like 1 year to receive green card, now just 8 months!

  • does somebody knows what could have gone wrong because we have no problems with the law at all, my husband came with visa and I am a citizen.

  • Two possible things, Sonia: (1) The INS may be investigating something that your husband may have experienced in his home country before you even met him, e.g., any local jail time? (2) The other biggie is if you are older than he is. That's what happened with us -- they could not believe that a younger man would really love an older woman. This never happens with the reverse -- old pot-bellied American men who go to Russia in search of cute little chicks. Very unfair but true.

  • My hudsband and I got married on our birthday and then we applied for a green card through a lawyer everything was fine. We showed up to the appointment and it went like a breezy it was fun, the interviewer didn't want to see the pics of our civil wedding but he did. when the appointment was over he told us we were approved. the appointment was sept 8/09 and we got worriedso we went on nov 12 to see what was going on and the lady told us we were lucky our case was still pending.

  • My spouse came in using a fiance visa which was only good one time for entering the U.S.A. and expired i think after 90 days.. After marriage, she had to change her name on her passport and turned it in along with expired visa when she did the "report of marriage" form.. We are waiting for new passport with her correct name now so she can visit philippines along with travel document.. She hasn`t received green card yet is only reason why she needs travel document to fly back home and back.

  • Don't you still need a K1 visa? If someone enters the US legally, marries a US citizen and attempts to apply for a greencard or adjustment of status and work permits, etc etc. Would not the immigrant be subjugated to Visa fraud? Because you're not supposed to attempt immigration while on a Visa, unless its a K1/marriage visa?

  • You don`t need a lawyer.. Just follow the instructions on the uscis website and down load all the forms from there.. I petitioned my spouse from philippines and had no trouble with anything.. It took 3 months to receive work authorization card after filing adjustment of status right after our wedding.. still waiting for green card of course after 5 months, but we are both working and everything is good..

  • Watch out for marriage fraud!

    -Be very careful when marrying somone that is an illegal immigrant. It can be very hard to know if they are marrying for love or the green card.

    -Never co-sign a credit card or car with a lover or new spouse.

    -Avoid mixing finances and legal issues together.

  • You can report her to ICE.

  • The issue is this one. If your wife ran off from you after a week she received the green card, my question is this. Which green card? the conditional or the 10 year card? Anyway I think is much more difficult if it was the 10 year green card. You can perform this action. You can send out a letter to USCIS where you stated that she got married with you with the fake intentions and you withdraw the petition officialy. That is the actual procedure to perform that issue. Be careful, I continue

  • I continue with this issue for you. You have to exactly perform this action or else, she can easily claim that you abandoned her and if she appeals with a lawyer, even though if you claim that you were deceived by her, she is going to win the case; therefore, she is going to gain the Green Card because the reason of your abandon. These are one of the weavers where the person appeals and win the case. So, YOU HAVE TO SEND OUT A LETTER TO USCIS stating that you withdraw your petition for her. Bye,

  • The immigration stuff is strange. The weavers of filling together are if you abandon your wife, if you divorce her, if you die, or if she is inflicted domestic violence from you. There are people who don't know this detail, they perform other action different than the exact thing that I told you and their wives or husbands get the green card because the petitioner (U.S. citizen) does not what is exact procedure to deport her/him.   • Hi Mr. Shusterman. Here's the scenario. Someone arrives from Mexico to USA on tourist visa and overstays the i-94 time allotted, and SENDS BACK their i-94 and their passport to get it stamped (to make it look like he really left USA "on time"), but he never physically left the USA. Now he wants a replacement i-94 (by form i-102). Will the replacement i-94 show that he was stamped as "departed" from USA? Or will it just show the date of entry information? He married USC and wants to adjust.
