can I have your permission to use this call on my new website? We post phone calls like this and blog stories about stupid collectors. Great site full of info and fun! -debtpuncher
Continued: Filing a police report on someone because they say they will take you to court makes no sense. If I owe you money, and I don't pay, and you provide me proof of how it's owed, then yes you can take me to court. How does it make sense to file a report? This is one bad attorney! Also the worker on the phone could have been nicer and should have their supervisor handle attorney calls in the future if they don't feel comfortable doing so.
I know lots about debt collection (FDCPA, and FCRA). The thing is if they provide validation of debt, and they send it to their legal team to review the case they are allowed to do that. According to him, his collection agency does it all the time. Remember FDCPA says they cannot state something that they DO NOT intend to do or cannot do. If they can send the consumer's account then they are allowed to. The worker is talking to an attorney so their is no threatening to the consumer.
I used to get calls from this morons like this, i asked him his address his name and i told em im officer Lopez from Orange county police department and they will be hearing from me real soon and they hanged up on me and never called again and out of curiosity i called back the same number and it connected me to to some random antic store in whittier hahah i laughed my ass off.
btw im not a real police officer, don't let this morons try and take advantage of you. Dam scum bags
@starlightperkins330 It's not a threat to say they´ll send it to their legal team if the collection company intends to take such action and is capable of doing so. The worker is not talking to the consumer, but rather the attorney.
@kianneis13 WRONG! The worker talked to the consumer's attorney (NOT the consumer), it is not illegal if they intend to proceed with suing if they are allowed to do it and intend to do so. If they are just making statements of something that they don't intend to do, then that's when they can get in trouble.
The use, or the express or implicit threat of the use, of violence or other criminal means to cause harm to person, reputation, or property as a means to obtain property from someone else with his consent. USC 18
The Hobbs Act defines "extortion" as "the obtaining of property from another, with his consent, induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right." 18 U.S.C. S 1951(b)(2).
He feels uncomfortable becos he lost control of the call - now suddenly the debt collector is getting some of the shit back he deals out 8-12 hours a day. Debt collectors are wankers.
@bazfanv2 I understand people shouldn't buy things they can't afford & all that, & bill collectors are "just doing their jobs" & what not, but they can get carried away. Now with the current economic mess, they are struggling themselves, so they're being overly aggressive & using every dirty trick in the book. They've even tried to collect from people that DON'T owe anything, but just have similar names of people that do! I've once had a bank account illegally/wrongfully frozen by the idiots!

It is extortion if you threaten people into paying them. It's pay me or else.

Wow, that's the first time I've ever heard a debt collector say "I don't feel comfortable" right after he makes a bunch of legal threat. hahaha

@bazfanv2 Duh because he doesn't know how to handle attorney calls! So the call should have went to a supervisor to begin with.
