You are saying that in some cases "special education" category can be used as a way to protect violent children from more formal processes such as commitment to a facility away from general populace, that in some cases, special education is used in a way that allows violent children to repeat assault. This type youth can also attack and injure other children. Another issue is that the special education professionals do not communicate to others that a student has history of violence.

@Joeey Yes, JOey that is what I'm saying. As far as communitcating to other professionals one of the first things I encountered when covering for another teacher is they would brief me on which students to look out for. I know this sounds harsh, but unfortunately it's true.

@xtremixt1 I also refuted the prison for mentally ill people statement--I showed that the prob is not prison sentences nor is it the solution. It's a failed health care issue. It is a matter of treatment & prevention rather than punitive measures after it's too late. We've seen this many times w/ "PPD" moms, schizos, etc. These people are diagnosed, show they are a danger yet do not get care or are hospitalized. they fall through the cracks. Now why don't YOU use your brain to analyze a point?

Btw, the death penalty (DP) is barbaric, stupid, & gets ppl off easy. It's far more punishment to let them rot in jail forever. But if even one, just ONE innocent life is put to death bc of an imperfect system (which it IS & will always be) then we can never get that person back and the ultimate injustice has been committed against an innocent life & the DP is an inherently unjust & flawed punitive option. There is no sound refutation against this critique. Airtight logic. The DP is stupid.

Mental health issues aren't "handed out" they are diagnosed. Prison will do nothing but make him more dangerous & when he comes out I pity his next victim. The failure is in the health care system--in this case, the mental health care system. He should have been committed & treated a long time ago. But in a HCS that's nothing but big biz for the insurance companies, these ppl fall through the cracks & society suffers for it. e.g.Women kill their kids, guys walk around hitting ppl w/ bricks, etc.

You may be well intended, but in a civilized society when we witness a crime of this nature we should do what we can to prevent the attack. Then, we immediately notify the authorities. Otherwise we have caos.

Thank you for your input. One of the reasons I keep this video up and running is because I have heard sooo many people pleading for the boy because of his emotionally disturbed label. Im trying to change public opinion on these mental health disabilities that are being handed out far too freely. Hopefully after enough people see this video they will realize the system is being abused in this situation.

No killing is a bit harsh even for this kid. As much as I detest what this kid has done and gotten away with he has yet to cross the line and take another life. If and when he does that I would support the death penalty, but only when he crosses that line.

Its important we remember not to lower ourselves to his level. Two wrongs do not make a right.

The problem is if we wait until then we lose innocent lives that we can never get back. The fact of the matter is a person like this is at a much higher probability of committing murder then your normal law abiding citizen.

This kid needs to be put in a facility where he can be watched, and should not be released for some time. 5 cases of brutally attacking women shows underlying issues that will not go away overnight. Emotionally disturbed or not, this kid needs severe punishment

If the kid was schizophrenic or truly mentally insane when this happened, and didn't have 5 prior assault and battery charges I might be a little more understanding, but this is outrageous. If this 16 year-old keeps getting away with this because he is Emotionally Disturbed how can anyone be held accountable.

This student needs to be "left behind". Kick his punk ass out or charge him and put him in a juvenile detention facility. He is a hazard to himself and others, and will remain so as long as there are no serious repurcussions for his actions.

That bus driver should sue the school district in order to facilitate an appropriate response on their part.

In all fairness to the school district if they have a court order they have to follow it. Having said that, why arent they providing some kind of security on the bus with a 16 year-old with 5 priors.

I dont consider the video cameras or radio as a form of security. At the very least how about some type of screen separating the driver from the passengers. Virtually all police cars have this feature.

Sadly you are right the good guys are going to have to start counter suing.
