I'd agree with Justice Kennedy on this one. A number of people are claiming that a child rapist is the epitome of evil because they take away a child's "innocence". What is innocence, exactly? It seems as if people are describing it as something tangible being taken, or like their goodness and purity is being taken away. Saying their innocence is lost is a lazy argument. I'd say that child rape is certainly depraved and heinous, but the victims can heal. Those murdered, however, cannot.

These monsters deserve the most severe punishment. A life sentence usually means they a paroled in 7 to 15 years unless the sentence includes the term "without possibility of parole, which they don't generally do. So at some point, they get out and do it all again. Dead perverts don't ruin future lives.

Child rape is just as bad of a crime as killing, if not worse. When you kill, it's tragic. When you rape a child (or adult), you're doing so much more. It impedes the child from living a normal life, functioning correctly, trusting; essentially killing the person, but they are living through it at the same time. I don't believe that it is worth paying for the criminals to be in prison for a life sentence. Someone shouldn't be executed for actions that can be corrected: i.e traffic tickets.

I am against capital punishment for child rapists because:
1. Children raped by their own relatives might not tell anyone because they will be afraid that their rapist/relative will be killed.
2. Children are easily coached to say whatever adults tell them to say. Adults can easily frame one another for child rape by doing this. Look at day-care sexual abuse hysteria cases for examples.
3. Burden of proof for the death penalty is high and rape is one of the most difficult crimes to prove.

Really the president could still give someone the death penalty because the constitution says that the executive branch (president) enforces the laws. All the supreme court does is interpret the constitution and therefore the laws, but it is up to either a state governor or the president whether or not he wants to enforce the law they set.

Unless of course they're released which I am all for stricter punishments for criminals. Death Row and Life Sentences are a waste of time. They should skip prison and and execute them shortly after leaving the court house.
Life in prison may be somewhat worse, depending on how you look at it(life in a grey box, shitty food, gangs, and the constant threat of becoming someone's bitch), but its a waste of Government money. I'd agree with Justice Kennedy on this one. A number of people are claiming that a child rapist is the epitome of evil because they take away a child's "innocence". What is innocence, exactly? It seems as if people are describing it as something tangible being taken, or like their goodness and purity is being taken away. Saying their innocence is lost is a lazy argument. I'd say that child rape is certainly depraved and heinous, but the victims can heal. Those murdered, however, cannot.

Children who are raped suffer the rest of their lives. They frequently commit suicide later as a result. Most grow up with horrific trust issues and live marginalized lives. These monsters deserve the most severe punishment. A life sentence usually means they a paroled in 7 to 15 years unless the sentence includes the term "without possibility of parole, which they don't generally do. Child rape is just as bad of a crime as killing, if not worse. When you kill, it's tragic. When you rape a child (or adult), you're doing so much more. It impedes the child from living a normal life, functioning correctly, trusting; essentially killing the person, but they are living through it at the same time. I don't believe that it is worth paying for the criminals to be in prison for a life sentence. Someone shouldn't be executed for actions that can be corrected: i.e traffic tickets.

The death penalty is in place for what some think is a deterrent. There is no evidence that that is true and some evidence that refutes the idea. The death penalty allows for people that use the law to make sure that dead men don't tell on them. @fasfsdfasd Well I can partially agree with some of what you said. Criminals ARE cowards! However so are we if we murder them once we have 'em in custody. Killing someone should ONLY be used to stop a crime from happening. Once those pieces of shit have done what they did nothing can change that. Executing them is more expensive than giving them life. Once they're locked up they can never hurt someone on the outside ever again. Yes killing a defenseless inmate IS cowardly.

I am against capital punishment for child rapists because:
1. Children raped by their own relatives might not tell anyone because they will be afraid that their rapist/relative will be killed.
2. Children are easily coached to say whatever adults tell them to say. Adults can easily frame one another for child rape by doing this. Look at day-care sexual abuse hysteria cases for examples.
3. Burden of proof for the death penalty is high and rape is one of the most difficult crimes to prove.

@SpiritTwilight I agree with you unfortunately rape is very difficult to prove. However I also appose the death penalty in ALL cases. It is nothing more than state sanctioned homicide. Life without parole IS a death sentence it just takes longer. Many inmate serving life sentences they that they'd rather die. So you're actually punishing them more by keeping them alive.

if the death penalty is applicable for treason/ espionage then it ought to be applicable for child rape. it IS proportionate to the taking of a life. at least treason/ espionage are usually committed for financial gain, child rape is solely motivated by depravity.

As fucked up as it is that these people raped a child, the death penalty just doesn't make anything better. Two wrongs don't make a right. You have to call yourself a murderer if your tax dollars pay to execute somebody. Obviously nothing our criminal system does looks into finding out the mental reasons people do these things, but rather just how we can punish them. So instead of finding any solution or solving problems, it just keeps happening.

Really the president could still give someone the death penalty because the constitution says that the executive branch (president) enforces the laws. All the supreme court does is interpret the constitution and therefore the laws, but it is up to either a state governor or the president whether or not he wants to enforce the law they set.

If you're good at hanging people you can either make them suffer for minuets, even hours, or you can snap their neck in an instant, that aside though. @jerry800 I for one disagree. Once somebody is in prison they're not going to victimize anyone on the outside. If you're not a prison inmate than you cannot be hurt by someone who is. Unless of course they're released which I am all for stricter punishments for criminals. I guess they could also escape from prison but the data shows that to be very very very difficult and unlikely. Especially with todays modern prisons and surveillance. Killing someone who is detained is cowardly.
