Wasn't really "Brand New" if i saw it taken out of the package then i would think it was brand new. But yeah i've seen a friend beat his Nano with a hammer and it still worked so its possible it wasn't fake.

Just to clear a few things up. My mate bought the ipod with hes own money, he earned himself. he smashed it up coz he wanted to what would happen. about 2 months later he was aministered to a mental home. i like this video as it shows the start of his turn.
