A president can't amend the constitution.. only Congress can through Article five of the constitution. Just this morning the White House released an official statement regarding sections 1031 and 1032. This section of the Letter begins with the words, "Detainee Matters: The Administration objects to and has serious legal and policy concerns about many of the detainee provisions in the bill." You can find this PDF statement by doing a Google search for "saps1867s_20111117".

Section 1031 is entitled "Affirmation of authority of the Armed Forces of the United States to detain covered persons pursuant to the Authorization for Use of Military Force." Section 1032 is entitled "Requirement for military custody."

@BereanStudent That document is dated Nov. 17. It did raise some interesting concerns from the president's administration, however, nowhere in the document does it address the concerns for the American citizen and the intrusion in and of the rights of citizens. It was merely about how it would be more difficult to pursue threats elsewhere in the world, and that it would unnecessarily tie up resources of local law enforcement and the military. Perhaps Barack just wants to parade around his words
