it's because the Republican Party is so staunchly against the current health care proposals. they'll do ANYTHING to stop it. Thus, Dems will likely need a 60 vote victory in order to move along smoothly.
We'd be better off with nothing rather than a bill with no public option. At least we'd have to take another crack at it again. If they pass this thing without a public option then Palin, Beck and Hannity have won.
Last I checked, 40% of the US population is already using a federal healthcare program.
Better question, what prevents the the federal government from using it's ability to tax states, and the commerce clause, to effectively force states to follow Federal laws?

Which allows congress to change that.
That said, I do agree with you that the congress shouldn't have outsourced that responsibility to the private sector.
If anything, the Federal Reserve, should be owned and operated by the Federal Government.
