There very fact that the paper is on tape means it is evidence. The criminal is a bank robber in Ohio who used a piece a paper with a demand note on there, plus he had a gun in his car. Seeing how he ate the paper, any jury or judge would convict him as destroying evidence. You wouldn't eat a grocery list if you were being arrested, would you? As you shouldn't run from the police if you haven't done any crime.

Obviously the cop didn't even know it was a "note" - for all he knows it was just some paper. And the officer didn't worry about leaving it within the suspects reach - they had both his hands! Nobody would think that he might eat it while he cuffed. I know they won't make that mistake again, but any officer would have made that mistake.
